Federal prosecutors at the Justice Department chided the House select committee investigating the Capitol riot for withholding hundreds of key transcripts potentially pertinent to DOJ's criminal inquiries.
Reiterating pleas from April in a letter to the panel Wednesday, prosecutors stressed that the Jan. 6 committee's failure to share the documents is stymieing its legal efforts against Capitol rioters. The letter represents the latest flare-up in tensions that have reportedly been simmering between prosecutors and the Jan. 6 committee for weeks.
Quote:
"It is now readily apparent that the interviews the Select Committee conducted are not just potentially relevant to our overall criminal investigations, but are likely relevant to specific prosecutions that have already commenced," the letter signed by U.S. Attorney Matthew Graves and Assistant Attorneys General Kenneth Polite Jr. and Matthew Olsen said.
"The Select Committee's failure to grant the Department access to these transcripts complicates the Department's ability to investigate and prosecute those who engaged in criminal conduct in relation to the January 6 attack on the Capitol," the letter continued.

Last month, Chairman Rep. Bennie Thompson (D-MS) responded publicly to that letter and signaled the panel would not accommodate that request. Following reports of the new letter, Thompson said the panel will not turn over the requested documents by the end of the week because it has a lot of work left to do in its hearings.
"We are not going to stop what we're doing to share the information that we've gotten so far with the Department of Justice. We have to do our work," Thompson said. "We will eventually cooperate with them. We have five more hearings to work through."

In a wide-ranging interview, she told Insider that in light of the January 6 hearings, Trump might have to be prosecuted in order to save American democracy ahead of the 2024 election. In that context, she said that DeSantis could take his place as a populist nominee.
"What we do find in history is prosecution, in the longer term, is one of the only things that deflates these guys' personality cults, because those cults are founded on the idea that they are invincible, they are infallible," Ben-Ghiat said. "Now, if that does happen to Trump DeSantis has already absorbed all the lessons of Trump."

That was a very short interview with him saying the same stuff he did in his OpEd. He did not say "any Republican candidate." He said Trump or his "anointed successor." Do you think Trump would anoint DeSantis?
The Greg Jacob interview was much more interesting with his testimony about his meeting with Pence, Eastman and Trump, where Eastman proposed two ways for Pence to reject the legitimate electors and conceding that his legal arguments are unlawful but he and Trump continued to pressure Pence to proceed with their plan anyway.
Hawg, is it possible that if the "Committee" released some transcripts for use by the Justice Department for prosecution, that ALL transcripts could be subject to discovery by the defense?aggiehawg said:Quote:

Excellent question. Prosecutors have an affirmative duty to provide the defense with exculpatory evidence under the Brady decision. Also there is a duty to reveal materials related to plea deals under Giglio that would be relevant to many Jan 6th cases.jrdaustin said:Hawg, is it possible that if the "Committee" released some transcripts for use by the Justice Department for prosecution, that ALL transcripts could be subject to discovery by the defense?aggiehawg said:Quote:

And the exculpatory nature of the whole is what they're actually afraid of, rather than their piecemeal usage of selected bits?
That's actually the first thing that went through my mind when I read the above...

Fox confirms that group of persons associated with The Late Show Stephen Colbert were arrested last night and charged with illegal entry to House office buildings after hours.
Fox is told the people were arrested in the Longworth House Office Building. The group was in the Cannon House Office Building earlier in the day trying to get interviews around the time of the 1/6 committee hearing
However, USCP shooed them away because they did not have proper press credentials
However, the group surfaced later that night after the Capitol complex was closed to the public Fox is told they took pictures and video around the offices of House Minority Leader Kevin McCarthy (R-CA) and Lauren Boebert (R-CO)
They were unescorted and arrested and charged with illegal entry. They were arrested near Boebert's office. They were released overnight.
Fox has confirmed the arrests of these nine persons through a senior House source.

Responding officers observed seven individuals, unescorted and without Congressional ID, in a sixth-floor hallway. The building was closed to visitors, and these individuals were determined to be a part of a group that had been directed by the USCP to leave the building earlier in the day. They were charged with Unlawful Entry. This is an active criminal investigation, and may result in additional criminal charges after consultation with the U.S. Attorney."

So yes, he used to have a good reputation but has been out of view until he resurfaced with Pence's team.
I noted that as well. He left in 2019. Did he resign, or was he forced out to take a smaller golden parachute? Or just fired?CanyonAg77 said:aggiehawg said:Former 4th Circuit Judge and was a respected conservative jurist.
