Federal prosecutors at the Justice Department chided the House select committee investigating the Capitol riot for withholding hundreds of key transcripts potentially pertinent to DOJ's criminal inquiries.

Reiterating pleas from April in a letter to the panel Wednesday, prosecutors stressed that the Jan. 6 committee's failure to share the documents is stymieing its legal efforts against Capitol rioters. The letter represents the latest flare-up in tensions that have reportedly been simmering between prosecutors and the Jan. 6 committee for weeks.
Quote:

"It is now readily apparent that the interviews the Select Committee conducted are not just potentially relevant to our overall criminal investigations, but are likely relevant to specific prosecutions that have already commenced," the letter signed by U.S. Attorney Matthew Graves and Assistant Attorneys General Kenneth Polite Jr. and Matthew Olsen said.

"The Select Committee's failure to grant the Department access to these transcripts complicates the Department's ability to investigate and prosecute those who engaged in criminal conduct in relation to the January 6 attack on the Capitol," the letter continued.
Quote:

Last month, Chairman Rep. Bennie Thompson (D-MS) responded publicly to that letter and signaled the panel would not accommodate that request. Following reports of the new letter, Thompson said the panel will not turn over the requested documents by the end of the week because it has a lot of work left to do in its hearings.

"We are not going to stop what we're doing to share the information that we've gotten so far with the Department of Justice. We have to do our work," Thompson said. "We will eventually cooperate with them. We have five more hearings to work through."

Not watching this clown show. But curious: has Ashley Babbitt's name been mentioned yet? Her photo put up on the display screen? Any discussion of her murder?

Yeah ... didn't think so ...

DeSantis is a 'very dangerous individual' because he has 'already absorbed all the lessons of Trump' but doesn't have any of the baggage, an expert on fascism argues
Quote:

Ruth Ben-Ghiat is a historian at New York University, and the author of the book, "Strongmen: Mussolini to the Present." She has studied the backsliding of democracy, from the US to Russia, and elsewhere.
In a wide-ranging interview, she told Insider that in light of the January 6 hearings, Trump might have to be prosecuted in order to save American democracy ahead of the 2024 election. In that context, she said that DeSantis could take his place as a populist nominee.

"What we do find in history is prosecution, in the longer term, is one of the only things that deflates these guys' personality cults, because those cults are founded on the idea that they are invincible, they are infallible," Ben-Ghiat said. "Now, if that does happen to Trump DeSantis has already absorbed all the lessons of Trump."

Sorry we can't let you proceed with cases in court where they will all be found not guilty, we have to keep the show trial going here in congress to try and distract America from our ****ty policies.

Well this went sideways.

Former Judge Luttig just called Trump a "clear and present danger" and then slams any Republican candidate in 2024 will also try to steal an election and not concede defeat. He didn't mention DeSantis directly but that was a pretty low blow.

Let's convict all criminals before they commit crimes. My kind of hanging judge, except for that whole due process thing.

Good lord, could he possibly have spoken any slower? Seems like a good indication he's lying out his backside.

Of course, I was distracted, because I kept expecting his tongue to come out and nab a passing fly, after which he would go "Ribbit, ribbit."

That was a very short interview with him saying the same stuff he did in his OpEd. He did not say "any Republican candidate." He said Trump or his "anointed successor." Do you think Trump would anoint DeSantis?

The Greg Jacob interview was much more interesting with his testimony about his meeting with Pence, Eastman and Trump, where Eastman proposed two ways for Pence to reject the legitimate electors and conceding that his legal arguments are unlawful but he and Trump continued to pressure Pence to proceed with their plan anyway.
Hopefully Trump anoints Pence.

Hawg, is it possible that if the "Committee" released some transcripts for use by the Justice Department for prosecution, that ALL transcripts could be subject to discovery by the defense?

And the exculpatory nature of the whole is what they're actually afraid of, rather than their piecemeal usage of selected bits?

That's actually the first thing that went through my mind when I read the above...
Who we are is God's gift to us. What we become is our gift to God.

Excellent question. Prosecutors have an affirmative duty to provide the defense with exculpatory evidence under the Brady decision. Also there is a duty to reveal materials related to plea deals under Giglio that would be relevant to many Jan 6th cases.

If you remember during the Michael Flynn case, his first set of lawyers had a huge conflict of interest in that it had there advice that his company was not required to submit a federal filing under FARA. And the Team Mueller used that fact to have his lawyers pressure Flynn to plead guilty.

The fact that DOJ is complaining that materials and information are being withheld from them by the Committee (meaning Pelosi) puts them in a bind and could affect some convictions and plea deals already entered.

Not holding out much hope because the federal judiciary at the district court level in DC is largely trash and the DC Circuit isn't much better.

Former 4th Circuit Judge and was a respected conservative jurist. He retired from the bench in 2006 to go be the General Counsel for Boeing and make big bucks. Left Boeing in 2019.

So yes, he used to have a good reputation but has been out of view until he resurfaced with Pence's team.

The problem here is the wording. Saying that your opinion is someone a "threat to democracy" is merely opinion.

Saying someone or some group is a "clear and present danger" has a legal meaning pertaining directly to national security, such as espionage by a foreign government, for instance. Although the Garland Justice Department has expanded that definition greatly, to include Moms at a school board meeting.

She had cover when a "respected" conservative judge like Luttig said it first, under oath at a Congressional "hearing."

Words can be dangerous when they have specific legal meanings, even of the public at large doesn't always understand their specialized meaning.

To say that Luttig's knowing invocation of that term was...uhm...improvident...is an understatement.
