A few problems, here.
First, Trump wasn't looking "to petition the government for a redress of grievances." As the head of the Executive Branch, he
was the government. Not only that, but his grievance was that he lost the election. Not much the government can do when he loses.
Second, his right to petition does not exempt him, or anyone else, from obeying the rule of law. Coercing others to break laws is a criminal act and is punishable, regardless of the reason for doing it. Conspiring to overthrow an election is a direct attack on representative democracy, one of the major, and novel, foundations of our nation.
It is much easier to fool someone than it is to convince someone that he has been fooled.
