If unintentional during the course of a felony, it is murder in Texas. If intentional, it is capital murder.TarponChaser said:Cromagnum said:

I'm admittedly not educated on it but I seem to recall that you can be charged with capital murder if you kill somebody, even unintentionally, while in the commission of another felony. I wonder if that would apply here.

HOUSTON Two people are dead and another person is hurt after a gunman opened fire on a possible homeless camp, according to the Houston Police Department.
The shooting happened around 8 a.m. near Neiman Lane, which is next to the intersection of West Tidwell Road and Wheatley Street.
Police said they received multiple calls about a man with a gun at the intersection. When they arrived, they were able to spot the gunman and take him into custody without incident.
After being arrested, the gunman confessed to police that he shot and killed some people down the road. Investigators began searching the area when they discovered a man and woman who were shot to death. They also found a third man who was injured and taken to the hospital. He is currently stable, according to police.
More details on this.
Again I say, WTH!

Her daughter was found shot to death outside the La Casita Apartments in north Houston in February of this year. She was killed, investigators say, because of retaliation for a robbery she was involved with.

Or he may have had enough awareness not to shoot the third guy in the back as he was running away, and thus no longer a threat. The two he did hit might have been blocking any shot at the third until that one decided he had made an error in the target selection process.
And frustratingly, I doubt we'll see any reporting on why that house was chosen.
