I'm admittedly not educated on it but I seem to recall that you can be charged with capital murder if you kill somebody, even unintentionally, while in the commission of another felony. I wonder if that would apply here.

(2) the person intentionally commits the murder in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat under Section 22.07(a)(1), (3), (4), (5), or (6);
Even if the suspect is eventually charged with kidnapping the 15 year old runaway (I doubt he will be), I don't think you can argue that he intentionally murdered the driver who died from the crash. So regular murder is the correct charge.

Or he may have had enough awareness not to shoot the third guy in the back as he was running away, and thus no longer a threat. The two he did hit might have been blocking any shot at the third until that one decided he had made an error in the target selection process.
And frustratingly, I doubt we'll see any reporting on why that house was chosen.

RBF Brooke Taylor says it was four suspects, not three, and shows bullet holes in a neighbor's car and shed that look pretty big for shotgun shot. Maybe the suspects were firing back?

I looked at the neighborhood on Google maps and streetview, and I couldn't find a location on the 16000 block of 1st Street that looked like a match. Hard to saw if the gunfire went both ways, but I'd say it's likely.
Initial reports of 3 suspects were probably based on the statements from the victims of the home invasion, who might not have seen all 4.
One bit I found interesting from that report - neighbors say they aren't worried, because they believe the invasion was targeted.

Regardless of why the house was invaded, 2 bad guys down. That is a start.
Given that it was a 4 person crew, and that they had masks on and guns out when they approached the house, it's probably an accurate assessment.
