HOA pools under siege!
At 11:45AM on Friday a drunk dude ran through a parking lot and crashed his car through a fence and into our community pool. He apparently was able to get himself out of the car but was too drunk to get out of the pool without assistance!
BREAKING: Robert Yancy Jr., who was serving a life sentence for continuous sexual abuse of a child, escaped from a prison in Brazoria this afternoon. Anyone who sees him is asked to call local law enforcement and not approach him.

Reminded me of one of my all time favorite movies...the original!Quote:
- Police Officer: Why'd you drive her car into the bay?
- Paul Crewe: Couldn't find a car wash.

The description of the gunman seems to be missing a detail.

Anyone in or near the '401 hear that gun battle last night around midnight? Started off with a 6 shot volley then about 20-30 minutes later, Fallujah with many different-sounding shots being exchanged. Can't find anything on the intertron about it yet.

There were a few jurors who wanted a not guilty verdict. These same jurors wanted only probation during sentencing. So outright letting them off in the name of equity isn't too far fetched.Ciboag96 said:

No. He's still guilty of manslaughter. They start again on the sentencing.
Tex. Code Crim. Pro. 37.07(3)(c)Quote:
(c) If the jury finds the defendant guilty and the matter of punishment is referred to the jury, the verdict shall not be complete until a jury verdict has been rendered on both the guilt or innocence of the defendant and the amount of punishment. In the event the jury shall fail to agree on the issue of punishment, a mistrial shall be declared only in the punishment phase of the trial, the jury shall be discharged, and no jeopardy shall attach. The court shall impanel another jury as soon as practicable to determine the issue of punishment.

So how does the new jury get brought up to speed. I'm assuming they're not just seated and told to determine a punishment for someone convicted of manslaughter. Does someone read the the transcript of the trial? Are they expected to read the transcript on their own?
Thanks for the info. It sounds like this could potentially end up worse for the guy since the defense will have to try and recreate any inklings of sympathy or doubt purely from his opening argument and a parade of family members that I'm sure will say that he was just about to start going to college and was going to be a doctor. The Wonderer said:1. 2. Sentencing opening arguments
3. Numerous witnesses put up by the defense about how he was always a good kid and never did anything wrong
4. Victim impact statements made by family and friends of the victim
5. Sentencing closing arguments
6. They deliberate until a sentence is reached
