Question here. If the Feds decide to pursue charges, do those charges supersede the state charges? How would this effect the death penalty? My understanding is that Trump reinstated the death penalty(?), but my concern is they do away with it later and he doesn't get executed at all. I know that is a lot of rambling, but hopefully you guys understand what I am getting at.
Would have no effect on the state charges as they're considered completely separate under "dual sovereignty".
This is why the states and feds can try you for the exact same crime, and even if found not guilty in one jurisdiction, you can be found guilty in the other.
Even if the feds did away with the death penalty later for all federal crimes, it would not impact the state conviction and punishment.
"If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves." - Sir Winston Churchill
