Interestingly, the data actually suggests that female jurors are often LESS lenient/forgiving than males in cases involving crimes against children.

I'd be hesitant to assume the long deliberations are due to all the women wanting to acquit due to insanity. They could easily be subdivided into multiple factions or the split could simply be over which of the charges they will ultimately convict her of. I could certainly envision and understand a debate between first and decade degree murder for example, which carries significant sentencing ramifications.

Also if they aren't going to convict her of first degree murder society it might be better if she is determined to have been insane. Historically people committed to psychiatric institutions for crimes like this (family massacres of some sort) don't usually get out, as the social and political pressure to keep them there is intense. If she is convicted of second degree murder she might be out of prison by her mid-50s.

Now I understand the moral and societal implications of saying she was insane in this case, but if she never gets out it's whatever.

We've reached a new point in the logical slippery slope of woman empowerment. Any data before now is dated.

There is little doubt what the hold up is here and who is in which camp.

The issue is that the Venn diagram of women supporting her and women who spend way too much time on social media is a near perfect circle. There are a lot of women who you'll never hear from that want her buried under the jail.

Did you see the videos from her supporters outside the courthouse a week or two ago? Plenty of boomer women.

I see plenty of women on twitter who support giving her the death penalty. Unfortunately those are the women who typically have higher IQs and were raised in a traditional family setting. Less likely to fall for any type of public school or university indoctrination.

But that describes an extremely small proportion of women. Still plenty of midwit right wing MAGA e-girls and their millions of followers who are on the side of Lindsay Clancy. They just think they have a smarter explanation for the murders than the leftoids.

The fact is the women outside the courthouse supporting her are all wearing pink. The jurors see this.

They have to understand the message they are sending by wearing pink into the courtroom as a juror on this particular trial. So even if they aren't wearing pink to support her, they have to know how it looks.

I mean, it's all relative to time and place. There are things that everyone (or nearly everyone) in this thread believes in that would have gotten us ostracized, excommunicated and/or jailed in earlier centuries. That fact in and of itself doesn't automatically make ideas bad or wrong.

The issue now is that we are at or near the end of the march toward equality across the board in the west and we're now inventing crisis to keep the progressive fire burning. That's the problem with that worldview, eventually you start running out of true injustices and have to start inventing them. Moreover, we're now experiencing the problems that come with TOO MUCH inclusivity and equality.

We aren't equal. Women can kill their children with minimal to no consequences.

The left is correct that we live in a tiered justice system, what they miss is that white men are in the bottom tier.

But women have always been treated more gently by our legal system going all the way back to OG English common law. That's nothing new.

And with respect to white men being at the very bottom, I definitely disagree. The statistics are very clear that multiple ethnic/racial demographics of men receive longer/more severe sentences for the same crimes compared to white men. For example, in states where the death penalty is legal black men convicted of first degree/capital murder are over twice as likely to get the death penalty compared to white men, and that's just for the last 30 years. The difference only gets larger the further back in time you go.

Yep, look how few women end up on death row after committing crimes that would almost certainly put a man on death row, especially in states like Texas and Florida; and even fewer are ever executed.

Back in 2003 a lady stoned her kids to death in the backyard because she thought God was telling her to do it. This was in Smith County just outside of Tyler. She was found not guilty by reason of insanity, was sent to a mental institution and released in 2012. That case was different than this one though in that the defense and state expert witnesses all believed she was insane at the time but the prosecutor moved forward with the case anyway because that's what he felt he had to do to try to get justice for the kids. I don't know where she is now or what she is doing but hopefully she hasn't had any more kids.

Andrea Yates is another example but she refuses to participate in the process which would allow her to be released. The speculation on that one is she's now sane but feels so terrible about what she did that she doesn't believe she deserves to get out. She will be in for life unless she wants out.

What I've always heard from attorneys though is that if there are women on the jury and your client is a female, you better hope they feel some sort of connection to her because otherwise they won't go easy at all, sometimes worse. Women tend to be more judgmental one way or the other.

It's possible there's some women on this jury who hate Clancy's guts for what she did.

The longer this goes on the more I'm thinking this is going to be a hung jury. Not like the Read case where the instructions are intentionally vague and the forms intentionally confusing. This judge actually knew what they were doing.

Do we think that maybe it had less to do with whiteness and more to do with quality of defense? Are we comparing gang bangers killing people to a middle class white guy who killed his wife? Food for thought. I'd guess that socioeconomic class has more to do with sentencing.

This is exactly right. And the determining factor for women judging other women is going to be status/attractiveness. Lindsay is extremely unattractive, therefore more relatable to the average woman. She is perceived as lower status (better read: helpless) for some reason, even though apparently the husband was making several hundred thousand per year and she had help from all sorts of people.

If she was a bombshell and dressed as if she's part of the elite in court then she would have no sympathy from women.

I agree with you vast majority of the time, but I don't see many adult women out here in Cypress wearing pink. I guess I see it here and there. Little girls at my daughter's school? Far more likely. If it's a group of women, I would just assume they're part of some political organization or going to a brest cancer fundraiser.

From my observations, pink is usually what women wear in groups and at rallies, as an act of solidarity/support.

I know "get on social media" is probably not sound advice...but if you get on Instagram, you will be blown away by how many women support her, or ooze sympathy for her. These are not bots...and many of them are conservative and moderate women. A LOT OF THEM ARE 1000% CONVINCED THAT HE DID IT. It's actually pretty disturbing to witness. My wife is half convinced women weren't meant to have the right to vote after I showed her some of this stuff...and just how many women are going to bat for LC.

Of course and it also has to do with several other things like criminal history and physical appearance in court. There are a number of obvious factors that play in to whatever "data" he's citing.

We also know in this current year that DAs and juries are far more sympathetic to minorities and women. Avalanche of very recent anecdotes online and I don't need data going back 30 years to tell me what is easily apparent in current year.

Peaceful people, especially white people are being forced to live with violent people, especially violent minorities. The same will happen in this case. She'll be out in less than 10 years trying to have new kids to kill.

It should be kept in mind that it is relatively uncommon among the states for the burden of proof regarding an insanity defense to fall upon the prosecution.

According to this link it appears that 9 states have a version of this rule: Colorado, Florida, Massachusetts, Michigan, New Jersey, New Mexico, North Dakota, Tennessee, and West Virginia (not a lot of logic or pattern to that distribution that I can see).

Utah, Idaho and Montana allow verdicts of "guilty but insane" (cannot be acquitted on the basis of insanity), and Kansas appears to have no provisions for an insanity defense at all.

In the other 37 states the burden of proof is on the defendant.

This is all to say that Massachusetts law is more favorable to Lindsay Clancy than the laws of most states, and she may be acquitted in Massachusetts for reasons other than the political viewpoints of jurors.

I have a hard time believing this is true, without other factors being in play (criminal record/history, severity of the violent crimes, access to competent attorneys etc.). Maybe black men tend to commit more heinous crimes? Maybe they tend to already have strikes against them? Maybe they don't hire the best lawyers?

But TBH, as someone who lives in a blue city, I really don't care what any study shows, I have eyeballs and follow local news...I also follow a crime thread on the Houston board. The number of violent black men with very lengthy criminal records who are released to kill and maim is VASTLY DISPROPORTIONATE. And it is all in the name of social/racial justice.

Also, young black males simply commit BY FAR the most heartless and barbaric violent crimes, in general.

Lastly...You were and probably still are a hardcore Fauci backer, I don't say that to disparriage you, I just say that for others to take into account when assessing your claims that the system is stacked against the black man.
