I respectfully disagree with this. A man or a woman who kills others because their brain chemistry was off (virtually every serial killer and school shooter ever) needs to go to prison. Even though it may not be entirely fair that they went schizzo or psychotic or whatever.

I just want to make sure you and others have this same feeling towards a crazy person who shoots up an elementary school. Or a man who snaps and butchers his family.

She will be out in 5-10 years if found not guilty by reason of insanity. The precedent in MA already exists

I said this before but the case was over before it started because the prosecution allowed these Karen, liberal nuts on the jury. Exactly like allowing 9 of 12 jurors in the OJ when they are black. Remember the interview of 4 of the OJ jurors saying they would NEVER vote guilty. Some of these DA's are completely clueless

The justice deserved will never happen under Massachusetts law. You could put any jury you like, but its highly improbable you'll ever get a unanimous jury voter of guilty under their law. She'll either keep getting hung juries or a NGInsanity verdict in Mass. Probably why defense was so willing to admit she did it.

In Texas she'd have been guilty the first time around simply because of the difference in law. Defense would have fought harder and not admitted anything though.

Andrea was found guilty of capital murder initially, but was overturned on appeal.

My understanding is Yates could have left her facility many years ago but is guilt ridden over what she did and believes its where she belongs.

Yes, although the retrial jury found Yates NGRI…I was using this example with someone, pointing to how no one supported Yates like all these Karen's are supporting Clancy…then I read about it and found the NGRI verdict. Surprised me. I believe Yates is passing on some annual review with a judge to determine release. She probably realizes she is in the best place for her condition.

I haven't really followed this thread, but I've kept reasonably up with what's going on.

Whats the deal with what I've seen in media headlines today? I've seen reports the foreman is speaking openly about the lone guy that led to the hung jury. I thought jurors were free to speak of their own experience only and other jurors were off limits.

I've never been on a jury so I honestly don't know that much about the process.

The court has no control nor repercussions over the actions of the jury once they have been dismissed.

They are free to say whatever they want.

Yes. Judge can ask them not to do that but judge also instructs them it is their choice whether they talk to the media or not post dismissal.

Were a judge to try to impose a gag order post dismissal (other than a national security case) it would be a prior restraint in violation of the first amendment.

That is not to say the jurors revealing that information cannot have other consequences however. If a doxed juror is harmed, there can be civil liability.

Juries should find the person guilty or not guilty. The defendant should then be able to appeal the conviction based upon insanity. The judge should hear from both sides medical experts and then decided insanity based upon the law.

This gives the defendant the ability to maintain a non guilty plea through the trial. It also takes it out of the hands of a jury that doesn't understand the medical basis for an insanity plea.

Innocent people are better off with bench trials, guilty people are better off with a jury. Which says a lot about the jury system and why I'm so critical of it.

When you combine total freedom from consequence with a complete lack of selection criteria, you end up with incompetent people making decisions they are not held accountable for.

The older I get the more I question the conventional "tis better a hundred guilty men go free than a single innocent man go to jail". Mostly because over time you come to realize that, statistically, the number of people who make it to a felony trial that are innocent is so small that it's within the margin of error. Effectively everyone on trial for violent crimes is guilty.

Modern technology and forensics has largely rendered the existing legal process for violent crimes counter productive. It really only serves to allow a huge number of criminals to go free or serve minimal sentences.

I've been married to my wife coming on 16 years now. We have a great marriage. she's not political at all. I asked her about her thoughts on this whole thing and explained what was going on with women supporting her. she said it was absolutely disgusting and hopes that clancy goes to prison for life at the minimum.

I expected that answer because she's a good Christian woman but I'm not kidding where if she would have answered in a way that any of these harpies did I would probably rethink our whole relationship. I'm not kidding either. This should be an absolute deal breaker with real men.
