Trump staging a rally on Jan 6 when the vote was going to be certified, knowing that the most radical elements of his base, e.g. Proud Boys, etc.. would show up, telling them to "fight like hell," telling them to march to the Capitol, etc... was reckless at best. That is not criminal.

But if there is evidence of admission that he knew he lost the election, evidence of intent to obstruct the certification, coupled with intent to set up fake electors in the swing states that is another matter.

yes, trump can say he was acting on advice of legal counsel. the downside is that opens up all of his communications with any of those lawyers to no longer being privileged. while some communications are already ruled not-privileged by crime-fraud exception, this would make all of the related communications not privileged.

If Trump was President and his DOJ or Trump appointed judges were indicting Biden, Hillary, or any vocal Democrat leader for the summer 2020 protests or mishandling classified documents the day after one of Don Jr.'s associates testified that the Trumps took bribes and covered it up...you would be SCREAMING for Trump to be thrown in jail and impeached from office.

While Smith is the one who indicted Trump, it will be up to a jury to decide guilt or innocence. And remember, it will be Trump's OWN PEOPLE who will be the witnesses called. It won't be democrats being called. Pointing a finger at who is divisive....that's not hard to look at transcripts from Trump's 4 years of partisan divisiveness (not to mention right wing media). All you have to do is look at FOXNews front web page any given day to see article after article of "Democrats bad.....conservatives good".

Since I was usually watching all of the hearings being held in Georgia, Arizona, Michigan and Pennsylvania being conducted before committees of the state legislatures, it wasn't just Rudy sitting there alone, he had dozens of witnesses testifying at each with dozens and dozens of other witnesses attending but not testifying due to time. I also watched videotaped interviews of witnesses coming forward to speak on the record and signing affidavits as to what they witnessed in the various counting centers.

How would that many people who did not know each other, lived in different states possibly be in on the alleged conspiracy?

All this shows is that in prior elections, the losing party knew how to question and object to election results. They also knew when to give up after legal avenues had been exhausted, something the Donald seems to be unaware is even a possibility.

After the hanging chad debacle of 2000, Congress passed and W. signed the Help America Vote Act in 2002. One of the provisions in Title III of HAVA is a minimum error rate irrespective of the electronic voting machine used that must be complied with before that system can be acceptable and the results can be certified. The FEC sets the guidelines on the error rate.

Of course, Pence ignored whether any of the disputed states had verified their voting systems complied with that requirement in possible (more likely than not) violation of federal law. So can improperly certified results not be challenged?
