I'm pretty sure he doesnt have to do that for double jeopardy to apply. It's automatic with not guilty.

Sandman wasn't wasn't charged with a crime. Kyle was. Very, very different facts here that will make winning a defamation case difficult.
Calling OJ a murderer after being found not guilty isn't defamatory.
