On the charges - am I wrong, or he can only be charged with one? So the big deal about 3rd degree being entered is that the burden of proof is lower so they are hoping that that will appease the jurors & make it easier to convict?

Burden of proof remains the same, it is still beyond a reasonable doubt. That having been said a jury finding of "depraved mind" is fairly ambiguous., in my view. The female juror this morning didn't like the look on Chauvin's face she saw on the video. When pressed by the judge, she finally admitted she could not afford Chauvin the presumed innocent until proven guilty required for an impartial juror.

Hawg - are you aware of a Batson challenge succeeding in the past 5 years? Seems like it's basically just a "we're trying" move now.

Edit: I mean all you have to do is come up with some BS reason and the judge tosses it.

Haven't followed that many trials, so have no idea.

Juror #39 is up. Male.

ETA: Sounds young, soft spoken. Married as wife told him yesterday how many jurors had been se;ected. So maybe not that young.

His wife expressed some concerns about his safety but he did not. Just felt that it was an big responsibility for being a juror on this trial.

Thought the fortifications at the courthouse were reasonable and expected. And now being told by the judge that the juror's names and faces would be protected helps to hopefully assuage his wife's concerns.

Sounds like a soy boy, doesn't like confrontation and is very hesitant to answer questions. Then he makes a reference to something that happened to him as a small child in connection with his inability to tell who was lying or not.

The first time I was summoned for jury duty, I went to the courthouse hoping not to be picked. As I waited to be interviewed, I realized that as inconvenient as it was, someone was exercising their constitutional protection to be tried by a jury. If it was me on trial, I would definitely want someone who would treat it intelligently and not just be whoever was too dumb to dodge jury duty. I decided to take it seriously, ended up being picked (I was in the first 10 jurors they interviewed) and never regretted serving.

Male, Hispanic, sounds younger. Soccer fan Real Madrid is his team. He was excited when he received the summons because it is such a big case. No fears for personal safety nor covid.

Used to be a manager so he had to resolve employees with personal disputes and the like.


ETA: Says after deliberations and full conversations with anyone disagreeing with him that he would be willing to stand on his principles and not just give in to go along to get along.

That same horrible question about media and discrimination. So he believes discrimination is as bad as the media makes it out to be. Just the opposite of the juror this morning and how he read that question.

Some jury consultant wrote that questionnaire.

Exactly why I've never tried to intentionally be kicked out of jury contention. I keep thinking...."what if it was me?!?!"

He strongly supported defund the police when he originally answered but he now thinks the police are overburdened and should have others take some of it off of them.

Again this guy is struggling to even articulate what he believes.

That's an astute observation. Verbally, he's not articulate but given the chance to think about what he is writing seems to be more representative of his actual feelings due to more time for reflection.

I'd still strike this guy though. Too scatter-shot and unfocused.

Finally got him to admit he cannot be fair and impartial! That was like having a root canal to get that out of him.

ETA: Wait! Is Nelson going to have to use a strike? Or will he be tossed for cause?

State made a Batson challenge because he was Hispanic?

Cahill strikes down the challenge which because Juror believed the viral video was akin to occupational force and his wife participated in protests. No race based finding here but Nelson still has to use a peremptory. That sucks.

Male. Sounds a little older.

He's a teacher but has made arrangements for a substitute if chosen for the jury. Recognized one witness name might have been a student over ten years ago.

While I agree, the judge has a certain role during voir dire and first it is to not appear to favor either side. On the blatant challenge for cause he's been a mixed bag, letting a few slide and then asserting some others.

Although I like Nelson he's too indirect and allows jurors to meander around too much. Needs to tighten these up in my view.

Let me come back to this for a moment. Those who have not been involved nor watched voir dire before, it generally does not occur in the manner happening here. There are larger panels sitting in the jury box and they are all being asked questions in front of each other.

Because jurors look to the judge as the authority figure in the courtroom, his demeanor is not lost on them. Hence the role the judge plays is less authoritative as in not appear to be favoring either side. HTH.

Defense counsel is rehabbing bad prospective jurors. I disagree with this approach.

Guy has an anti-police vibe. SJW as to systematic racism. Still maintains he could be impartial however. Warning signs but not enough to get him tossed for cause, yet, in my view. Cahill seems to hold out for an actual statement that the juror will not be impartial coming from their own mouths. But he is a teacher. Used to law and order within his own classroom. But as the recent year has shown, teachers are just as BSC as many others. He's a wild card.

Court is in recess until 3:30 when this jury prospect will return for further questioning.

We are back.

Juror went to see the George Floyd Memorial and then posted it on his social media and described as the site of Floyd's murder and was inspired at the sight of the "holy ground." A feel good moment with everyone coming together. Guy was proud he posted that.

Nelson uses his peremptory. He's gone. That the defense's 7th strike.
