Thank you for the reply.
Among the latter, under pretence of governing they have divided their nations into two classes, wolves and sheep.”

Going to ask a completely stupid/ignorant/uninformed question for all you counselor-types:
Considering the defense believes that the states case is very weak (of which I don't disagree here), why wouldn't Chauvin ask for a trial by judge instead of a trial by jury?? Could he have not done that in this instance?
Again, sorry if I've seen too many Perry Mason episodes for the extreme naive question....

Nelson asks if she worked ER? No.

Has she ever been involved in resuscitative efforts? Yes. Therein lies another potential issue. He's torn on this juror.

A bench trial is risky because the rules require the request for trial by jury in many jurisdictions without knowing which judge would be hearing the case. Further, even during the course of pretrial and trial something could happen to the judge and another one takes on the case.

She pretty much admits she believes Floyd was choked to death:

1) mentioning she knows how long it takes to be choked unconcious
2) says how could someone kneel on him until he was dead
3) said "considering Floyd died, yes he kneeled on him too long"

After all that she then directly said she "didn't have an opinion on how he died, or if Chauvin was responsible"

Yeah, that's why I'm not so sure if she would be good for the defense.

Thats an understatement. Now she says that she believes the media is NOT overplaying the race inequity narrative.

She works with ventilators and with covid she's very busy. Cardiac care and ICU.

Cardiac care?? I hope Nelson knew that before he passed her for cause.

Thnx for the response

Not to be argumentative here, but if the FACTS of the case rule the day (as they should), would you really care about how temperamental whatever judge you may get would be??

Again...this ain't my baleywick, so forgive the ignorance of the question....

It doesn't have to be Thanksgiving to have a turkey on the bench as lawyers often joke. At the state level these are elected people. Politicians.

Lunch recess. Reconvene at 1:15. Have one juror remaining from the morning's session to get through after lunch.

I think I might have used a strike on the nurse, but I guess they know what's coming up and are hesitant. She seems fair, but I'm not convinced she can put her medical training aside. If only the prosecutor had asked her about taking directions from a police officer vs a citizen on the street ......

No s***. I am very worried about that juror standing up in the jury room saying she's a nurse and weighing in which expert witness has more credibility with her. Confirmation bias since she already believes he choked to death.

OTOH, she has experience with opioids and their effects and when she hears the evidence of how much fentanyl and meth he had on board, his lungs filled with fluid, the foam around his mouth, his medical condition with hypertension and narrowed arteries including 75% blockage of an artery? That's a lot of medical evidence in contravention of he choked to death.

As a cardiac care nurse those facts should really open her eyes (I hope.)

There must have been some other stuff in that questionnaire that Nelson thought made her good if he didn't strike

I sure hope so. But he had to confer and return with more questions three separate times and Judge Cahill also had to intervene and ask her some questions. So it was touch and go on whether they would strike her or not.

If this were a regular case that had not been international news, likely the state would have struck her because the medical evidence is not on their side. Maybe Nelson made the calculation to force the state to use a peremptory and it backfired??

If Nelson can play to her on the medical evidence, I think it will work well. Just hammer home the point with expert testimony the toxicity of the drug combination and Floyd's medical condition perimortem/prior to arrest.

There is also another consideration here. The state is really trying very hard to convince Cahill to allow one of their experts, a Dr. Vincent testify that Floyd was not resisting arrest because he was in the middle of a mental health crisis. She sounds to me like a SJW type who believes in Critical Race Theory and even went back to slavery and Jim Crowe law eras to explain away Floyd's apprehension upon his arrest. The race based stuff.

This nurse is very open to that narrative as well as she believes there is discrimination and to the level it infects the criminal justice system.

At the end of the day, will her medical background convince her that Floyd died of an OD? Or that the officers were somewhat responsible? That's where the 3rd degree murder charge as the exit ramp comes into play.

Hope that was clear enough to follow.

IT systems worker. Followed the case closely before getting the packet identifying him as being in Floyd case.

He's fearful for his personal safety and he knows his identity is stored in electronic file somewhere and from his profession he knows everything is hackable.

Weird, he is more fearful of returning a guilty verdict. So does he think the cops would come after him?

He said on the questionnaire that the cops "accosted" Floyd. With evil intent? Yes.

This guy is a walking red flag for the defense.

Chauvin caused Floyd's death and Floyd was a non-violent offender and the didn't deserve "the use of lethal force."

So the knee restraint was "lethal force"? Yes.

You have formed strong opinions? Yes.

Systematic racism and over militarization of police force.

But when pressed says he can still put aside his strongly held convictions in his capacity as a juror. Skirting the line.

Nelson is going to have to use a peremptory on this guy, in my view.
