Quote:

A Manhattan jury has found Daniel Penny not guilty on criminally negligent homicide in the death of Jordan Neely.
Marine veteran Penny, 26, placed 30-year-old Neely in a chokehold after the older man began acting erratically on a New York City subway, according to law enforcement. Witnesses said Neely, a homeless man, was yelling and acting erratically on the F train after boarding, adding that they felt threatened by his behavior. Prosecutors said Penny held Neely in a chokehold for approximately six minutes.
The more serious charge of second-degree manslaughter was dismissed last week after the jury was hung.

Actually pretty shocked at this. How could they have been split on Count 1, but a unanimous Not Guilty on Count 2?

Jurors may not be book smart or legal smart, but they are probably street smart. Recognized the bait & switch that the prosecution tried to pull and wouldn't stand for it. Even if the defendant is a white man.

The holdout was probably a true believer that became disenchanted with the judge/process when the first count was dropped and flipped as a form of retribution.
After the judge dismissed count one, those who were for acquittal could go back saying, "See? We were right as the judge dismissed it."

The fact that this verdict took this long is going to make good Samaritans think twice before coming to aid.

At least one juror put future victims at risk. Way to go moron(s).

I travel to NYC a few times per year for work and have for 20+ years. Never had an issue until the past few years. Guy pushed his way past me as he got on the subway (crowded and I was by the door), and threatened to stab me and others. Announced "I have a knife and I will stab someone". No way am I intervening to help others with the nonsense happening there. Looking out for Numero Uno and that's it. I stepped off that car as the doors closed. Good luck to the rest of you

Wasn't his "father" a deadbeat absentee that showed up on the scene after his son was dead?

He should counter sue Neely's dad for being a better father to Jordan Neely, than his dad was. Jordan should have been choked out when he was a kid for the better of society.

I won't complain about the verdict, but that's a very strange verdict.

Bragg can't retry the hung charge can he?
Bragg has proven that he and New York judges can do anything they want to do.

I'm waiting for Bragg to announce he's changed his mind on dropping the first charge. He had his fingers crossed behind his back so it didn't really count the first time.

I want to laugh at this but given Braggs history of running a 3rd world banana Republik justice department there, I can't put it past him to try it

That's so disappointing. I'd always heard bad things about New Yorkers and how they treat tourists. But when I went for the first time back in '08 timeframe, I was blown away by how friendly people were. I was lost trying to find a specific subway station so I asked a man walking down the street. He didn't just point me in the right direction, he actually took the time to walk me to the station to make sure I got to the right place. (No, he wasn't flirting. Middle aged black man, who was just very friendly). Thanks, Obama, for setting race relations back so far.

No. Bragg asked for it to be dismissed after jeopardy had attached.

There are a lot of great people. But they've collectively put some horrible people in charge. It's a shame but the whole thing is sliding. That was the most glaring personal encounter I've had, but in general, I've seen more nonsense the past 5 than the first 15.

Yup. Brag should have zero place in a free society. He and Liz should be forced to fight to the death. Two enter, two buried after.

Apparently the mob is interested in the idea of rioting tonight. Good. I hope NYC burns, they deserve it for being morons and letting the mob run your city and these race hustlers be your leaders.

Personally I have no plans in ever again going to NYC except possibly change planes through one of the airports. I will take my money and time and spend it in much nicer and safer places.

Also, if I were ever in NYC for some reason I am not helping anyone for any reason because I do not want to go to jail or be sued for helping. So if you need the least bit of protection or even CPR or Mouth-or-Mouth, don't look to me.

Penny's acquittal notwithstanding....the process is the punishment. Alvin Bragg has still succeeded in his quest to outlaw bravery and heroic action by private citizens.

Yes. Dismissal after the jury is sat would violate the double jeopardy rule. There's mountains of precedent for that.

The fact that he wasn't acquitted in 10 minutes is all the proof you need that there was at least one complete dumbass on that jury.

The holdout hoping to jail him for a serious charge realized, after the first charge was dismissed, that the DA was just looking to get some kind of face saving victory and gave in to the rest of the jurors on the justification issue, rather than wasting more time on deliberation which were not going their way.
