I continue to be astonished by how terrible the judiciary has become. I clerked 26 years ago - there's no way my judge would have pulled half of this garbage.

Did they ask for a mistrial on the basis of the protestors being heard or some other reason? That tweet seems to imply that it was because of the protestors.
No, it's because of the dismissal of count one and instructing them to go on to count two.

Jury has reached unanimous verdict on count 2 per Inner City Press.

Not Guilty per Inner City Press

Crazy to think they went not guilty on count two but hung on count one. Maybe the holdouts had some time to think about it this weekend.

Way too close for comfort. Charges should have never been brought and this DA should be thrown in jail

Did the jury actually come out and deliver their verdict? How is this known?

Actually pretty shocked at this. How could they have been split on Count 1, but a unanimous Not Guilty on Count 2?
Easy come, easy go

How were they hung on the 1st one but quickly on the lesser??? Did the jury read social media over the weekend? LOL.

Has to be there was a lone holdout, and they had a change of heart over the weekend.

The holdout was probably a true believer that became disenchanted with the judge/process when the first count was dropped and flipped as a form of retribution.

I'd guess 11-1 not guilty for Count 1 and the lone hold out finally just gave up and wanted to be done with it so voted not guilty on Count 2.
"If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves." - Sir Winston Churchill

I won't complain about the verdict, but that's a very strange verdict.

Bragg can't retry the hung charge can he?

"You have to come to a unanimous verdict before moving onto the lesser charge."

"Can't do that."

"Do it."

"Can't."

"Fine, ignore the first one and move onto the second."

"But didn't you say..."

"Ignore what I said."

"Fine. Not guilty, and thanks for wasting our time."

I'm waiting for Bragg to announce he's changed his mind on dropping the first charge. He had his fingers crossed behind his back so it didn't really count the first time.

The only thing I could think of is that the hang-up on Count 1 were 1-2 jurors in favor of CONVICTION with the rest supporting an acquittal. Then those 1-2 either changed their mind, or were confused with some of the judge's instructions.

The fact that this verdict took this long is going to make good Samaritans think twice before coming to aid.

At least one juror put future victims at risk. Way to go moron(s).

No, that would still be double jeopardy.

No. Because they decided to drop that charge in the hopes that Count 2 would be a guilty.

Pretty sure he can't. Once you get a verdict, you can't just recharge with something different for the same act. You get a single bite at the apple, otherwise it's double jeopardy.

Don't see how. He dropped the charge after the jury was sat. I'm no lawyer but that sure sounds like a second bite at the Apple to me.
