Stay strong holdouts.
I agree.Aggie Jurist said:
I continue to be astonished by how terrible the judiciary has become. I clerked 26 years ago - there's no way my judge would have pulled half of this garbage.
No, it's because of the dismissal of count one and instructing them to go on to count two.4stringAg said:
Did they ask for a mistrial on the basis of the protestors being heard or some other reason? That tweet seems to imply that it was because of the protestors.

Way too close for comfort. Charges should have never been brought and this DA should be thrown in jail

And of COURSE, protesters outside are in a screaming FRENZY. Shouting that Penny will NEVER have peace in NY.
Disgusting trash. All.

Actually pretty shocked at this. How could they have been split on Count 1, but a unanimous Not Guilty on Count 2?
Has to be there was a lone holdout, and they had a change of heart over the weekend.Gator_2 said:

I'd guess 11-1 not guilty for Count 1 and the lone hold out finally just gave up and wanted to be done with it so voted not guilty on Count 2.Gator_2 said:

The only thing I could think of is that the hang-up on Count 1 were 1-2 jurors in favor of CONVICTION with the rest supporting an acquittal. Then those 1-2 either changed their mind, or were confused with some of the judge's instructions.SwigAg11 said:Gator_2 said:

This is what I'm really confused on?

I won't complain about the verdict, but that's a very strange verdict.
Bragg can't retry the hung charge can he?

No. Because they decided to drop that charge in the hopes that Count 2 would be a guilty.Kenneth_2003 said:

Don't see how. He dropped the charge after the jury was sat. I'm no lawyer but that sure sounds like a second bite at the Apple to me.Kenneth_2003 said:
