Depends on the state. There is no universal rule here.



In New York State, "defense of third parties" is not an affirmative defense. It must be raised by the defense but, once raised, the prosecution must disprove it beyond a reasonable doubt. If it were an affirmative defense, the defense would have the burden of proof. This is also the rule in Texas and most, if not all, other states.

I read the NY statutes. You made the blanket statement that self defense and defense of others are affirmative defenses when n they are not. Name a few states where they are.

I'm really interested in how this turns out.

Why would any "good guy" who is not inclined to stand around and just watch someone get victimized EVER go to these cities and states where you're already considered the enemy, especially if it's optional?

How can big city folks be so messed up? How much of this degradation of our country is planned and financed by Soros and our enemies? They are flat getting it done.

I'm sure they won't miss my money but I'll never go to these places and put myself or family at risk. It's amazing how men can spend hundreds of years building stuff only to tear it all down.

My big question is:

If what he did was a crime, what SHOULD he have done? Just stood there until someone gets seriously injured or killed? Does the law say he has to be stabbed before it's a reasonably perceived threat?

This is what I think the juror should ask himself. What would a reasonable person have perceived. You can't Monday morning quarterback it and say in a perfect sterile environment this is what you should have done.

This trial is why people in New York pull their phones out and don't help. These people get what they vote for and the good folks trying to help pay the price along with the victims getting beat on when folks don't help.

Sadly doing the right thing isn't on the minds of most people, even LEOs these days. I've helped police several times and one time it almost got me arrested since a cop was butthurt I took down someone that 3 of them couldn't (nothing special I did, guy was looking back at the cops when he passed me).

How dare a strong male protect weaker people from a threat. That is how humans have made it so far is having those strong men protect everyone.

This is where jury nullification should reign. Specifics and legality be damned. I've assumed from the get go that Penny's actions contributed materially to this guys' death. But locking up men who act for public safety is societal poison.

This must be the most frustrating jury.

There is at least one person holding out (probably for a guilty verdict), with the rest of the jury just wanting to end this nonsense just screaming at this person in disbelief.
