Trump has ruined the case from the start by his social media posts. I would not be surprised if it immediately gets dismissed.

Isn't Trump THE DOJ? Isn't the DOJ just a delegation of the Presidents powers?

There is no law that the DOJ is unbiased from the President. Unfortunately. People would like that to be the case, but multiple Presidents have used the DOJ for their political goals.

Also, the President has freedom of speech as well. There should be no way that this gets dismissed outright early. GJ adds weight to the charges for one.

But IANAL, so what do I know?

I was listening to a legal podcast discussing selective prosecution. Usually that is a garbage motion to dismiss, but in those cases you don't have the President of the United States accidentally posting a directive to the Attorney General demanding that she hurry up with the selective prosecution of his political enemies.

It's funny, you lefties used to remind us that Comey was a Republican and pure as the wind driven snow when he was going after Trump. Now that Trump's DOJ is prosecuting Comey, he is now a "political enemy".

The oy relevant example for this thread is the lie he's indicted for.

I didnt ask for a video sheriff. I asked of anyone has a link to the testimony. What McCabe said is the key to the case!

Remember Leticia james running on "getting trump?"

Some quotes
Quote:

Oh, we're going to definitely sue him… We're going to be a real pain in the ass." (campaign remarks compiled by PolitiFact, Aug. 12, 2022).
PolitiFact

She called Trump a "con man" and pledged to shine a "bright light into every dark corner of his real estate dealings." (AP, Sept. 28, 2023).
AP News

PBS also summarized that she "fixated on Donald Trump" during the 2018 race, branding him a "con man" and "carnival barker." (PBS NewsHour, Sept. 28, 2023)

Didn't matter to his case that thos protector pre determined trumps guilt and aggressively pursued some charges.

The case went on.

Also remember that he fired the last prosecutor who didn't indict Comey. And he hired an attorney with four years' experience as a replacement. which he probably hand-selected to indict Comey. Then add his more recent Truth Social posts on top of that.

The defense will get emails and texts regarding all of this, and I'd bet there is additional damning info out there.

Everyone hates Comey. He single handedly got Trump elected by making statements about Hillary's emails about a week before the first election. Then he pumped up the Russiagate crap and bungled that. He deserves prosecution but I fear Trump torpedoed it.

So commenting publicly that his attorney general should get moving on prosecuting actual crimes is "selective prosecution"? Is Comey going to claim he is the only one ever in the history of the United States to be indicted for lying in sworn testimony?

If he lied, he's guilty.

Everyone on the left and most of those in the middle particularly supposedly reformed Biden voters are now immune from prosecution?

TDS is not a legal defense. Sorry.

Andy McCarthy thinks the case is weak and goes nowhere.

Probably the strongest evidence that Comey will be convicted.

Specifically though, his take was that if it was based on the Ted Cruz exchange which is evidently referring back to McCabe testimony about McCabe authorizing leaks (not Comey), then Comey's statement to Cruz saying Comey did not authorize would be consistent and not perjury.

I do not know enough of the details but over the past few years, McCarthy has developed end-stage TDS and I have noticed he and Turley are more often in disagreement than agreement.

At the end of the day, just watching the left look like the biggest hypocrites is worth the indictment.

Thanks!

He hems and haws, bit when he says "that my recollection" that's enough for an indictment for sure!

What will McCabe say now is the key. Won't be an easy case, but Comey deserves all he has coming!

A president asking the AG to look into crimes is not a basis for dismissal! Lol.

Similar to the Charles Manson trial. Nixon declared Manson guilty and they unsuccessfully tried to get a mistrial based on jury being prejudiced. Same will be tried here, but this is more problematic. Here the President not only declares a person guilty, but then shops around until he can find a prosecutor to indict.

Why don't you try lying to congress and see how that goes for you. The fact that it's Comey is just icing on the cake. I want to see that ****** in an orange jump suit. It probably won't happen, but I can dream.

I will say this. Trump can pick some hotties. Alina Habba and now this:

The defense lawyers will have to strike all the men off the jury.

I do a fair bit of criminal work, and a tiny bit of federal criminal work, and in watching the Comey testimony and the McCabe testimony, I can see how a prosecutor could get 12 votes to indict on the grand jury, but if I were a prosecutor, I wouldn't be super pumped about putting McCabe on the stand as my star witness.
