A president asking the AG to look into crimes is not a basis for dismissal! Lol.

Don't believe so.

Gipper is correct. I did not do a lot of criminal work while practicing. But when I was in law school we had two full years of required classes, which included several criminal law related semesters. Further, I was a trial attorney on the civil side. That meant being a jack of all trades, master of none depending on what the subject was. So those skills translate to criminal matters.

Comey is crooked but also smart. This case is weak because they went the McCabe route instead of Prof Richman.

I was listening to a legal podcast discussing selective prosecution. Usually that is a garbage motion to dismiss, but in those cases you don't have the President of the United States accidentally posting a directive to the Attorney General demanding that she hurry up with the selective prosecution of his political enemies.

There was no "accidental" posting

Has anyone said what the third count was? They were trying to get the grand jury to indict him on that was no billed?

Not that I have seen. The problem with a lot of these potential charges is the statute of limitations issue. Those bad actors were allowed to get away with their crimes for too long.

Just the PITA aspect and huge legal fees that come with defending themselves is about the only true consequences here.

Considering you were so right about the Fani Willis case I'll reserve judgment.

Comey testified he never leaked or authorized anyone to leak. McCabe testified he leaked and Comey authorized it. One of them is a perjurer.

Definitely possible. Ted Cruz said their testimonies were directly contradictory to each other's, that it was impossible for both of them to be telling the truth.

I expect Soros and the Dem machine to fund his defense.

Also remember that he fired the last prosecutor who didn't indict Comey.

Because that "prosecutor" was deliberately obstructing until the SOL ran, as the left has done with most of the conspirators. But you know that.

I wonder how the statute of limitations help Manafort or Trump in NYC, when they enhanced a state misdemeanor with a federal election crime he was never charged or indicted for? Andrew Weissmann tolled the SoL willy nilly like it was nothing on several cases.

Comey is worth tens of millions. He doesn't need their help.

#1, I'm sure he made good money on Russiagate.

Secondly, I suspect this is good writing, but give me your thoughts.

Hate is how progressives sustain themselves. Without hate, introspection begins to slip into the progressive's consciousness, threatening the progressive with the truth: that their ideas and opinions are illogical, hypocritical, dangerous, and asinine.

Basically agree with them. My caveat though is we don't know which DOJ attorney will actually be the one doing the presentation in court.

There appears to be some misreporting on what Comey was indicted for in count #2. Its the Richman leak, not the McCabe leak

Why was Comey not autopenned? Any speculation?

Regardless of what Jim Comey thought the Democrats hated him for what he did on the Clinton emails so they have left him out to try to be the fall guy.

Maybe the autopen operator thinks Comey is a jackass too.

Its a real shame they let Comey's lawyer helper, Kevin Clinesmith, off the hook in lying to FISA judge. We know Comey ordered Clinesmith to change the assertion from negative to affirmative on Carter Paige. Its how they got the warrant to spy on Trump.

How do we know Clinesmith was following Comey orders? Bc he didnt even lose his law license, virtually no consequences. That doesn't happen to rogue agents. That happens to those who take the wrap without snitching on their superiors.

James Comey lied under oath when he said there the FBI didn't spy on President Trump's campaign. I hope he gets convicted of perjury and faces some prison time.

Based on my two decades covering @fbi
@TheJusticeDept
a thin indictment suggests a holding charge with the potential of a more complex, superseding indictment that adds more charges.

This is not only possible, but plausible in Comey's case based on the recently declassified FBI leak investigations via @FBIDirectorKash
codenamed "ARCTIC HAZE."

The "ARCTIC HAZE" records reveal several FBI senior leaders and Columbia Law Professor Daniel Richman said they coordinated media leaks at Comey's direction.

James Rybicki - former FBI Chief of Staff
James Baker - former FBI General Counsel
Andrew McCabe - former Deputy Director
Daniel Richman - Columbia Law Professor

Just want to point out that a placeholder indictment for Comey will not void all statute of limitations issues on all potential charges. Our criminal procedure is based upon notice, meaning giving a criminal defendant reasonable notice of the crime(s) of which he is being accused. So we'll have to wait and see.

If it even goes to trial, a jury wont convict Comey unless there are records of him bragging about lying. The "knowingly and willfully" standard wouldnt matter with a Bannon or Flynn type, but with Comey, they will give him every opportunity to wiggle free.

The NPC sheep are slurping up Comey's sanctimonious speech about "standing up to Trump". Its sad there are so many brainwashed morons in society.

So a video from a national broadcast of Comey lying to Congress, when he was asked, "Did you ever authorize anyone from the FBI to be a confidential source to the media?" And he answers no, and then you play another video of him openly admitting under oath to Congress, that he gave his notes he wrote after his meeting with Then President Trump, to his former college roommate, then FBI Special Government Employee (SGE) Daniel Richman to leak information to New York Times reporter Michael Schmidt. That's pretty solid evidence.

By all rights, that should be the end of the jury's inquiry during deliberations but it won't be.

Hell, I am long retired and could mount a defense of him. Scream, "CLASSIFIED!" and excuse his conduct.

We all know Comey is a serial liar. He embellishes his stories way too much in his answers.

Now he has the right to remain silent but he doesn't have the ability.
