🚨 JUST IN: James Comey will appear in court on his federal felony charges on JANUARY 5TH, 2026.

Get him convicted, ASAP.pic.twitter.com/cgWdE0eu1u
Comey's two-day trial date was just set of January 5th in Alexandria Virginia. It is an ironic choice since that is the anniversary of the critical controversial meeting of Comey with President Obama and others on laying the foundation for the Russian conspiracy investigation.

...Now on the ten-year anniversary of that infamous meeting, Comey is scheduled to appear in court to answer for two federal charges related to alleged false statements connected to leaks from the FBI.

Comey is reportedly planning three threshold challenges to block his prosecution: vindicative prosecution, selective prosecution, and an unlawful appointment. I wanted to briefly address these claims, including the one that has the most credibility.https://t.co/vQZRtPggyL

OLC deputy Alito: "Thus, it would appear that Congress [pursuant to 28 USC 546] intended to confer on the Attorney General only the power to make one interim appointment; a subsequent interim appointment would have to be made by the district court."

(My point isn't that Alito…

Ha! I had forgotten about that. It was definitely weird! I didn't realize it was the same person!
But the legal analysis remains interesting.
Trump just had his Nevada acting US attorney have indictments dismissed on related, but distinguishable, grounds.
Will Comey seek to have the indictment dismissedon that basis? Or will he stick with "let's go to trial"?
Quote:
In Siebert's case, his term expired 120 days after his Jan. 21 appointment by Acting Attorney General James McHenry, on or about May 21. After that, Whelan said, Eastern District of Virginia judges appointed him to continue to serve.
Comey has the advantage of being able to cite a memorandum by none other than Supreme Court Justice Samuel Alito from when he served in the Office of Legal Counsel in 1986. Alito concluded that "after the expiration of the 120-day period further interim appointments are to be made by the court rather than by the Attorney General." He added, "it would appear that Congress intended to confer on the Attorney General only the power to make one interim appointment; a subsequent interim appointment would have to be made by the district court."
The Trump Administration can argue that Trump fired Siebert, thereby vacating the office for a second time. Under this argument, the process restarts with the vacancy. Comey will argue that this could allow a president to circumvent the intent of Congress by firing acting U.S. Attorneys to daisy chain vacancies allowing endless new 120-day periods to run.
The WSJ is reporting that former FBI director Chris Wray is under investigation. “Former officials have received subpoenas in recent days in the Wray inquiry, according to a person with direct knowledge of the matter.”

Suspect this urgency only reduces his fees.

I suspected there might be a superceding indictment for Comey.
The latest filings in the Comey case reveal a battle over whether he should be allowed to keep sensitive discovery materials. Lindsey Halligan argues he should only be allowed to review them under supervision. Comey, hilariously, wants to keep them in his own possession,… pic.twitter.com/uWPLVQ0Q1f

I think at some point Comey flips. They are all guilty as sin, first one to flip gets the best deal, particularly since Comey is at the center of most all of it.
With folks like Pritzker championing for removal of immunity for federal law enforcement officer, even more reason for Trump DOJ to ruin these guys before 2028 gets here.
Comey should be housed at Gitmo whilst awaiting trial. For his own safety of course. Give him a pink jumpsuit, a tutu, makeup and Taylor swift tapes and he'll be at his on Ritz @ Gitz.

Comey aint flipping, he believes his actions were righteous, besides the system cherishes thugs like him and circles the wagons.

It is more likely Comey's case is dismissed than it is he is convicted. Note: this is not a comment on the evidence or facts against him; but on the venue and judge.

How much time do you think he is realistically looking at? Because unless he has some disease or gets shived in the shower, he is not going to spend the rest of his life in prison if convicted. 3 or so years would be the most likely.

Sad commentary about the state of our justice system

You are probably true about the pardon.
Prosecuting the ICE agents would be sheer suicide. Maybe selective prosecution of any extremely violent behavior, but blanket prosecution of ICE would go over really, really well in strongholds like SF, Chicago and NYC, and would go over like a nuclear bomb in the rest of the country. Very, very stupid thing to do.

Which system? Because Trump has shown you he is not playing around. Comey is getting convicted and looking at prison likely for the remainder of his life. It only takes one wheel coming off one wagon for the circle to fall apart.
I get not having faith based on things like Mueller, Durham, lack of perp walks 9 months on, but these guys committed most serious crimes at the highest levels. And they used their power and conspiracy to cover the tracks as best they could.
Their last hope when lawfare failed was to assassinate Trump.
And you should hope I am right. Because if Comey escapes we are most likely looking at much more violence. Or an apathetic right who lets the left getting back to walking all over them.
