It does not establish a "free press" It says, quite clearly, that CONGRESS shall make no LAW abridging the freedom of the press (press is not capitalized nor defined).
It becomes a weak argument that Trump, whilst still allowing multiple news agencies to cover the WH press briefings, allowing CNN access to live video feeds afforded to others who may not be in the room due to capacity and security constraints, is somehow abridging or curtailing press access.
It's a weak argument saying that them not having access to yell negative **** at him is somehow curtailing their ability to go on their free platforms and continue spouting that negative **** to the public without interference is abridging their freedom.
Simple facts at play here. Congress made no law here abridging the freedom of the press. POTUS made a decision based on whether to continue to allow propagandist agitators to attend WH briefings under the guise of "covering the news".
Given how deranged CNN has become and their long history of lies and fabrications, Trump should prevail here.
Trump needs to let them back in, set them in the back of the room, and never call on them. The court may rule they have the "right" to be in the room. But, there is no "right" to a front row seat or to be called on.
Further, the press staff need to introduce new "decorum" rules.
You're only allowed to speak when called upon. First offense you will be told to stop. If you continue, or speak out of turn anytime later in the briefing, your rights to attend will be suspended for 1 month. A second offense results in a permanent ban.
This would apply to ALL of the press in the press briefing room. (not viewpoint related, applied equally)
It would stop the bull**** that some of them are doing. Like when Acosta wouldn't give up the mike when Trump told him to stop and even pulled the mike away from that poor staffer girl.
Remind the press that they are there at the pleasure of the POTUS and if they can't follow simple decorum rules then they have no place there.
CNN will get permanently banned in the first 2 months because they're staffed with arrogant *******s.
