then binger starts going down a line of questioning about past events kyle was a part of which is in direct disregard to an order the judge issued making those things inadmissible.

From reading, and watching what little I have, it seems possible that the prosecutors would rather have a mistrial than what looks likecould be an acquittal. Then, even if they don't retry, Kyle is never considered innocent after a fair trial. The left will continue to characterize him as a "murderer" with no danger of libel.
He's not on trial for driving without a DL.
