shoot to stop. shoot to stop.shoot to stop. shoot to stop.
this would have been a better answer but i *think* he did ok....
My thoughts are don't say "used deadly force" but "used force to stop"
But it was deadly force. Just because you use deadly force doesn't mean you intend to kill.

Judge giving him hell.
This isn't inept. He doesn't have the law or evidence on his side so he is throwing his hail mary.pacecar02 said:
How inept can you be
Stand corrected. Binger was implying about Kyle remaining silent until now. That's a comment about Kyle's 5th amendment rights.BlackGoldAg2011 said:i believe the line was in danger of committing "a grave constitutional violation of his 5th amendment rights. "you had an AR armed with 30 rounds"
"You could have killed 30 people"
WTF?
And if you are ever on a Jury i hope I can be too so i can argue vehemently against this asserting during deliberations. because it IS NEVER the defendant's duty to prove or even defend their innocence, it is the state's duty to prove beyond reasonable doubt that they are guilty. and any juror who takes a different mindset or position is an affront to our justice system.aTmAg said:Obviously, I disagree. As a layman potential juror someday, if a defendant doesn't testify, I assume he has something to hide. It becomes a "prove to me you are innocent" situation rather than "prove he is guilty". I don't care what lawyers or the judge tells me.Strongweasel97 said:I disagree. This is not a savvy choice, but a defendant's choice to tell his story.aTmAg said:I think not testifying would have looked bad to the jury. Even though it's not supposed to. And the defense team is savvy enough to know what they had when called him.Strongweasel97 said:They are not in a lose-lose. This cross was their lifeline in this case.aTmAg said:
I predict prosecution will come off as browbeating an innocent kid. They are in a lose-lose. Either they play nice and he comes off innocent, or they browbeat him and they come off as a-holes.
The problem is: I think he stood a good chance of being acquitted before his testimony. A good cross can bring enough doubt to hang a jury and give the prosecution a chance to polish and correct in a new trial.
It's not the same as not talking to the police. Where everything can be used against you but nor for you. Not talking DOES hurt you in front of a jury. He's behind the curve is he doesn't testify and the evidence would have to overcome that. If he does testify, I consider him even. Then his believability would either win or lose the day (as far as his testimony goes).
Disagree. He acknowledged a fact.Sea Speed said:FriscoKid said:

He should not have answered that with a yes
If he is, then he charged the wrong person.FriscoKid said:
