It is generally worth remembering that, under the law of the United States, unlawfully entering this country is a misdemeanor.

That misdemeanor only becomes a felony if you re-enter after being formally deported.

The Biden administration's border policy was disastrous.

Why does that mean that the entire rule of law has to be thrown out the window? If the law doesn't matter because a large number of citizens, even a large majority, didn't like the outcome of one bad policy, then the Constitution wouldn't be worth the paper it's written on and we would no longer have a workable democracy. The Fifth Amendment still applies to every person, and the laws still have to be followed and respected.

We can't just throw the Constitution baby out with the bad border policy bathwater.

I knew that the penalty for a misdemeanor is generally "less than a year." But, you're right, the penalty unlawfully entering the country is shorter than I had expected.

That's interesting. When I was in the military, it was drilled into us that in order to use deadly force, we had to know that the person we were inflicting deadly force upon had the opportunity, capability, and intent to use deadly force on us or others. I was under the impression that law enforcement had similar requirement for use of deadly force.

Running away does not meet the requirements of that CIA triad. Why does running from police constitute use of deadly force?

There was a Japanese sailor who was captured, actually attacking and invading the United States on December 7, 1941.

We didn't kill him.

We shipped him to Wisconsin.

The entry is civil, but the running is not. No LEO knows what they are working with when the perp hits the gas. He was shot for the criminal part. This isn't hard.
