He said he can adjourn Congress and make appointments. That doesn't mean he should. We'd be going crazy if Biden did this to install some purple-haired moron during a recess.

If Biden's Secretaries all resign before the recess, there is a danger to the strategy as Whalen points out that SCOTUS could find it un-Constitutional.
https://www.nationalreview.com/bench-memos/supreme-court-could-invalidate-intrasession-recess-appointments/
Quote:

In brief: The Supreme Court might well rule that the president's power to make recess appointments is limited to intersession recessesthe recesses between two Senate sessionsand, further, that it applies only to offices that become vacant during that recess.

Those are the positions that Justice Scalia, joined by Chief Justice Roberts, Justice Thomas, and Justice Alito, embraced in his powerful concurrence in the judgment ten years ago in NLRB v. Canning (2014). Scalia condemns the "tragedy" of the "majority's deference to the unconstitutional recess-appointment practices of the Executive Branch" and the "damage done to our separation-of-powers jurisprudence more generally."

It's a very safe bet that Justice Gorsuch, Justice Kavanaugh, and Justice Barrett would agree with Scalia if they were looking at the issues afresh. So that would make a six-justice majority among the current members of the Court.

I'm sure it's already been said on this thread somewhere, but this is never going to happen. Ever. He will not get 51 votes. And I for one am thankful.

I wouldn't count on that. Trump has a mandate now.

It's not about losing the house, it's about the margin of error.

Republicans can't vote together on anything. The one thing I can say for Democrats is that they move in lockstep.

If we hold the majority with, say, 221 seats and three are not there to vote, we have literally zero room for error.

And you can bet that the Democrats will get to at least one rino Republican with all kinds of incentives to oppose Trump's agenda.

Not if Elon has his way, he'll donate to any campaign against any rino that goes against Trumps plans.

He will or there will be a lot of primary challengers for senators on the right.

And I hope they all cry like *****es when Elon give their opponents 10 mil a pop for primary season. Or triple that.

Agree with the first paragraph. I'm ok with attacking with all his might, but taking advantage of loopholes always comes back to bit you in the ass. Normally it's the Dems that learn this lesson. I don't want to see it go the other way

Seeing where multiple Republican Senators speaking on condition of anonymity are saying he will never be approved, full stop.

I wonder if Trump knows this and will come in behind him with someone like Paxton who will then look like a solid compromise after the fact, though may have received a little resistance had he been the first nominee?

Ann Coulter thinks its 4D chess....

With Gaetz having resigned from congress today there's no backsies, so who knows. Pride cometh before the fall.

I asked this earlier in the thread but I'll ask again. When is the last time a Republican senate didn't confirm a Republican president's nominee?

Both are meh.

Prostitution has always been around and should be legal. And we are stupid for infantilizing 17, 18, and 19 year olds. They are the backbone of our fighting forces and all throughout history have been married and bearing children.
There's a difference between a 21 year old interacting with a 17 year old, and a 30+ year old doing it.

Something about young love hooking up is understandable, whereas an older guy preying on an underage female is creepy and downright wrong.
Maybe but there has to a line drawn in the sand legally. I am perfectly fine with that being 17.

Edit: Just curious what age gap do you think is appropriate for a 17, 19, 21, or 25 year old?
Responding to you and the other poster in one reply. I understand the legal distinction and I'm not arguing on those lines. Just speaking to it from my ethical perspective. Doesn't mean others see it the same way, I understand that. No issue with a consenting 80 year old and 25 year old. But when you start approaching the cradle, there's some diligence and judgment required to ensure you're not taking advantage of a youngster who might be all the willing in the moment to engage. I can't define it precisely in words, but I know it when I see it. And a 30+ year old with a 17 year old doesn't smell right. Take it fwiw, thanks.

That is your opinion. I was a LEO for over a decade including a fed that worked international alien smuggling for prostitution and then later after attending law school, a felony prosecutor. We have bigger fish to fry than two consenting adults engaged in a voluntary transaction.

I have my own opinion based on experience.

And you also know as an LEO that this is what he actually got CAUGHT for. Cause you were a pretty sorry LEO if you don't know that.

Ever seen a pedo reformed? That's a rhetorical question, in case you actually didn't know. Wanna run the risk that the chief prosecutor might be one? Also rhetorical.

I don't consider sleeping with a 17 year old to be a pedo.

I had to deal with these types of cases all the time. 16 and 20 year olds ... poured out at the grand jury. 35 and 17 year old ... legal. 35 and 15 year olds ... straight to prison.

Except there's typically not a scheduled recess until late March. Is Thune just going to call a recess on January 21?

We shall see, but I have to believe there was a plan already in place…deals were already cut…

Maybe it was a "we will compromise on Thune, but he needs to call a recess for Gaetz to assume his role as AG without confirmation, and to make House members happy, we will back Johnson without a fight, and we will make it harder to remove speakers moving forward…"
This seems plausible. Interesting idea.

All I know is that Trump wouldn't pull the trigger on this unless there was a plan in place. If you filter out all the online rumors, and Democrat, CM, and RINO hysteria, the power brokers seem to be very confident this is going to happen.

We'll see. There are checks and balances in place for a reason. I'm on board with everything Trump has done up to this point. I talked myself into Pete H. Not 100% on Tulsi, but I'm open. The only thing that Matt Gaetz cares about is Matt Gaetz. He's a major liability and it could backfire. Plenty of other candidates that could do the job and maintain respect for the office. That still matters.

17 year olds are children. Not legally but they're still children. It's gross and their are character issues for a man over the age of thirty being with one.

I am not goaltending. I am someone that had to draw these lines legally and enforce a workable system. Everyone has a different view and we have to have a standard.

There is no such thing as barely legal. It is either legal or not. And once it is legal I don't give a *****

I also do not vote for my politicians based on their personal lives unless it is a gross deviation from accepted norms that I find disqualifying.
