I'm hoping Chirafisi give Kyle's close because Richards is terrible at verbally communicating. He may be a great fact lawyer but his communication skills are iffy.

Not usually. Jury instructions are usually mostly done before trial even begins. But this trial hanged midstream with unicorn evidence fairy dropped a drone video on the state's doorstep mid trial. Usually that evidence would be excluded.

For continuity's sake, it is nearly always the same lawyer that gave opening also do closing.

The other problem is that this Judge really doesn't read very well. He misspeaks then corrects himself when reading.

Jury will be lost. As far as they know the charges are the same as what they were first told by the judge. Now suddenly they will hear about the lesser included which to them will sound like additional charges. Not the best procedure here.

He can't use it on the count itself. But, if they acquit him on the charge with regards to Rosenbaum, they need to acquit him on the charge with respect to McGinnis.

Judge pushing back on camera resolution and "science", which is pretty good. Pretty much said that by submitting questionable evidence (the blurry enhanced pic), this will fall apart on appeal.

Kind of a nice out for the defense.

Judge says if there is a conviction, the pixel issue is baking in reversible error. But he's going to allow it.

Judge is going to allow the jury to measure the rifle even though no evidence of length is in the record. Short barrel rifle count stays in.
