Judge: If both parties want me to read self-defense instructions every time, I'll do it, but I think it's a monumental waste of time. But if you insist, I'll do it.
I rely on you to make timely objections, because I've prepared 36 pages of instructions using brief form.
Not that I'm aware of.Gator92 said:
Court TV this morning said there were 16 jurors.
Were others dismissed?

Judge: State had asked if self-defense repeated for every charge, they want provocation repeated every time.
Chirafisi: State doesn't want that anymore.
Kraus: We'll waive that in interests of time.

Not usually. Jury instructions are usually mostly done before trial even begins. But this trial hanged midstream with unicorn evidence fairy dropped a drone video on the state's doorstep mid trial. Usually that evidence would be excluded.planoaggie123 said:

For continuity's sake, it is nearly always the same lawyer that gave opening also do closing.sicandtiredTXN said:
I'm hoping Chirafisi give Kyle's close because Richards is terrible at verbally communicating. He may be a great fact lawyer but his communication skills are iffy.
That's good for the defenseQuote:
These instructions are going to be so confusing that the jury is going to be lost.
Yup. And even if they weren't confusing, anyone being read 37 pages of unfamiliar material may only comprehend and retain 5% of it.FriscoKid said:

The other problem is that this Judge really doesn't read very well. He misspeaks then corrects himself when reading.FriscoKid said:

Doesn't it seem like the judge is really dropping the ball today?
After Friday, how in the world is this not already finished properly? There was a whole weekend for instructions.
Why is that?AcctAg11 said:
So it sounds like Rittenhouse can't use self defense on the counts related to McGinnis? I missed Friday, so I dont know the origin of those instructions, but can someone explain what's happening with that?
He can and they are adding language to the charge to clarify.AcctAg11 said:

Chirafisi: Change to "if defendant was acting lawfully with respect to Rosenbaum, conduct did not create unreasonable risk to McGinnis."
Judge: I'll do that.
No State objection.
He can't use it on the count itself. But, if they acquit him on the charge with regards to Rosenbaum, they need to acquit him on the charge with respect to McGinnis.Quote:

Judge: They have photo and video and testimony from person who worked on it.
Judge: I'm not going to give cautionary instruction, but I believe it's high risk for the case.
