And don't forget there's a third party no one is talking about anymore. Imran Awan and his brother had unfettered access to secure Capitol Hill communications as well as the DCC and DNCC. All the garbage about the DCC/DNCC hacks and the Awan's were elbow deep in those servers. And it was proven that they had been accessing all those servers remotely from Pakistan and no one raises an eyebrow????

And I'm still suspicious of why they pled them out and made
them disappear to Pakistan never to be heard from again. I'm betting Daniel J Jones who was a former FBI and US Senate investigator under Feinstein and is directly involved in the Durham investigation and Joffe and the GTech group and possibly the DRU

Durham, for the most part. That is not to say Sussmann's lawyers will not be successful on any of the motions. Judge will split the baby on a few but overall Durham has the stronger argument on the important pieces of evidence.

The revelation of the Text messages from Sussmann to Baker, where he put into writing the lie he is indicted for, prior to him going into the FBI offices and telling the same lie he told in the text, pretty much kills any defense he has on his not guilty plea, and the fact that Durham revealed that he lied under oath to the Senate, the exact opposite of what he said in the text to Baker and what he told Baker in the presence or Priestep and Anderson.

His argument about Materiality is pretty much toast, due to the fact that the lie he told initiated the investigation into the falsehoods he told about the Alfa Bank pinging, All it's going to take is Priestep to say, "had I known he was working for the Clinton's, it would have been taken with a grain of salt, or handled differently or whatever" Fact remains the same he lied that affected the investigation and that makes it material PERIOD.


The mention of the Hillary Tweet is being looked at by many as her linking to what was going on making it a conspiracy, and it was in furtherance of the crime of lying and defrauding the Gov. That has the possibility of making it a criminal conspiracy on several levels. I'm betting Durham has a lot more in his bag of tricks and is playing this out to its fullest.

Durham also let it be known that there are several conspiracy crimes the the SoL doesn't effect and still are in play. That has to make all involved nervous. It's also raises the question, When is Sussmann pushing for an immunity deal for Joffe if his SoL has already run out? I have a feeling that Sussmann's counsel already suspects there's a problem, and they are looking to get Joffe immunized so he can take the wrap for pulling the wool of the eyes of Sussmann so the defense can be, "He was duped too" WHich is a load of crap but they are running out of options. Durham is spacing this out on purpose to gauge what everyone's hole cards are.

Yeah, I suspect that the more there are rumors of people seeking immunity with him, the more the people at the top of the chain begin to sweat and wonder if they should consider asking for immunity. He may end up offering immunity to the highest bidder.

Prof Cleveland made an excellent breakdown of Durham's latest filing. Durham is kicking the bushes now and things may start ramping up.

Sussmann's defense is shot. He's got nothing left and Durham is compelling documents that are now going after the "conspirators" and all the documents they withheld claiming privilege. In my mind Sussmann is a slam dunk now just based on his own actions. If it were me I'd take the transcript where he was deposed under oath to congress and said what he did, and claimed to Congress he informed the FBI who he was working for and was transparent and I would just hand it to the jury in full, then take the recorded statements from the FBI general counsel and their agents, where he said 'why' on the exact same subject and they are two totally opposite statements that are on the record. Then you can just hand the jury the hard copy notes and say, this is what he said and now the actual texts he sent to Baker. He lied plain and simple TWICE. What's the defense gonna say? 'Well, he was just joking to Congress UNDER OATH, the FBI's notes are inaccurate, the FBI's recordings of these conversations are wrong, multiple agents got it wrong. The general counsel for the FBI came in and testified during this trial and lied? He's got ZERO fu***** defense for any of that. And his materiality defense is straight BS.

Now enter all these documents Durham's seeking and the conspiracy with the conspirators becomes real is the furtherance of the crime to defraud the government, interfering in a presidential election, abuse of government access to illegally surveil Trump, possibly numerous cyber crimes. Then you have these foreigners that the Clinton's funded to get involved in the election against Trump.
