I don't think they are disputing he said he wasn't representing any client, that he was presenting the evidence to them on his own. The defense's position is that isn't material to the investigation.

Yes, but the tweet says the text saying he wasn't representing anyone hurts his case. They aren't disputing that. I don't think that text affects anything.

Sussmann seeking to preclude the use of these notes, arguing they hearsay not subject to an exception is laughable given this is the basis for 302's that are held as gospel to prosecute others. It may also confirm that Priestap has testified before a grand jury something was posited here many many pages back Durham argues as he well should they are admissible. To see the names Preistap and Anderson re-emerge is nice to see.

…someone is trying to hide something. There is case law supporting that position, out of concern the jury would make an adverse inference. Some courts handle the problem with an instruction explaining what the privilege is and why assertion of it doesn’t imply anything bad.

As to whether there is a privilege, it appears that Fusion and perhaps Perkins Coie have withheld certain information from the GJ on the basis of the Clinton campaign’s privilege. As to Fusion, it’s not the client, so it sounds like it’s actually asserting work product.

Not entirely sure. Haven't been given an explanation or anything noting the specific tweets. Best as I can tell, they are alleging I perpetuated a targeted harassment campaign against Dawson. One of his minions has taken credit for reporting me (it was one tweet).
