10-7-01. First strike against Afghanistan

Massie can not like it as much as he wants, but he's dead wrong on the constitutional question.

If he doesn't like a president having that kind of power, he's an effing senator. He should have been working to reform the War Powers Act to curtail this ability.

Trying to find the war powers act in the constitution…

Let me help you.

The Constitution authorizes Congress to pass laws. They passed the War Powers Act. The Constitution authorizes the courts to review and interpret the War Powers Act. They never declared it unconstitutional... yet.

Ok, so we don't ever have to declare war again. We could literally drop a nuclear bomb and wipe out Mexican cuz "prez is CnC".

I learn something new on this board everyday.

That's actually 100% correct. We never declared war on Iraq or Afghanistan either, despite being there for years.

Your lack of even the basic understanding of how the U.S. government works is actually appalling.
An Authorization for Use of Military Force (AUMF) was passed almost immediately post-911 against "terrorists" (vague, right?) that served as the authorization by Congress to attack....terrorists -- that justified, I guess the Afghan war (we thought Osama was there, which he was, but he fled to Pakistan after Tora Bora). Another one was issued in 2002 in Iraq leading to our operations in Iraq in March 2003.

There were no AUMF declarations passed in Congress for:
Kosovo (late 90s) - Clinton
Libya (2011) - Obama
Yemen - Several.

And more.

With past attacks from Iran and Hezzbolah in the region for the last several years, you could argue that the 2001 approval against "terrorists" would apply here.

Either way, it doesn't matter at all. Just idiot replicants, repeating their idiot leaders talking points.

If the Democrats try to impeach him over the bombing of Fordow they will be lining up on the 20 side of another 80/20 issue. It's like a moth and flame. They can't help themselves.

Really the Democrat party has become nothing but a useless pustule on Americas ass. They are on the wrong side of damn near every issue right now. Them flocking to Twitter threatening impeachment is just par for the course of their complete disconnect with the American people.

You're not arguing legality there; you're arguing justification. That's a separate issue.

As far as legality goes, Congress has given the Presidency the power to commit troops to combat for up to 60 days (plus 30-day withdrawal period) without Congressional approval. He simply must NOTIFY Congress within 48 hours of the action.

There are arguments that the WPA is unconstitutional, but several of those arguments actually say that the WPA unconstitutionally limits the President's powers as the CINC.

It's reasonable to disagree with the decision and argue the merits or drawbacks of this action. It seems to me, however, that there is no question as to the legality of this action.

Of course the main news media saying "we are now a nation at war". And while that's a possibility, right now we just did a quick strike and retreat. The language is purposeful to feed the idiots who think Trump committed an impeachable offense ordering this strike.

All politics aside, this is just objectively false. The President absolutely has the authority to launch an attack on foreign soil without military provocation and without congressional approval. Moreover, literally every President since Herbert Hoover has done so.

He didn't declare war. He authorized a tactical military strike. As Commander in Chief, he can do that.

Hell, Obama killed an American citizen with an authorized strike.
