And then this tidbit. A few weeks after the indictment was handed down, someone at Biden's DOE noticed Trump still had security clearance for that agency and sent a memo saying his clearance should be removed. pic.twitter.com/cjCu9VJ3gI

Jack Smith just filed his omnibus motion in response to Trump’s various motions to dismiss. It’s hard to underscore how risky it is for DOJ to defend 1512c2 based on 2 very muddled appellate court rulings perhaps headed to SCOTUS for review. pic.twitter.com/UjLqnGGaVg

This case is increasingly pointing towards an appeal by the government regarding Judge Cannon's handling of the CIPA process. We're not even to hard part of CIPA cases.
Judge Cannon’s order today not only postpones many trial deadlines in USA v Trump (MaL)—one by >17 weeks—but suggests she may allow an unprecedented approach to a CIPA issue that may force govt to bring an interlocutory appeal ...https://t.co/aYrwEd5pA8

Interesting that giving a defendant enough time to mount a defense is such an issue.TXAggie2011 said:TXAggie2011 said:

What would the effect be of them winning an appeal on the timeline?TXAggie2011 said:
An appeal wouldn't be about the timeline but rather the procedure Cannon is adopting under Sections 3 and 4 of CIPA
I agree. I think our entire justice system should have biased judges for a while going forward. And the trick is to get your case before someone who holds the same biases. That way we won't be convicted of anything. But if you get one on the other side, its a guarantee.Im Gipper said:
Given how insanely biased the DC and NY judges have been against Trump hard for me to give a flip this lady is biased in his favor.

So, what is the purpose of the appeal?TXAggie2011 said:Ag with kids said:What would the effect be of them winning an appeal on the timeline?TXAggie2011 said:

By the time they got through the appeal, she re-worked the scheduling order to reflect another procedure, and they got through that procedure, I can't imagine it would notably speed things up.
The only way the speed of this case were to notably accelerate would probably be if a winning appeal was followed by a winning effort at obtaining her recusal. (Edit-And I'm not saying she should recuse. I'm saying that's the only way the pace seems it would pick up.)
At least that's my view.
government’s trial, date proposal, which Cannon has ordered Trump to respond to by July 6, includes a detailed timeline of everything leading up to the trial, in particular, the classified docs litigation.

Since Smith has no case and Trump has several layers of defenses, I imagine the DOJ is in no hurry for any activity on this.
Pure posturing. They don't want to hurry up. The only way they would be okay with hurrying up is if Trump pleads guilty and agrees to leave the country never to return.TXAggie2011 said:fka ftc said:

Nah. The docket in this case is full of Trump asking for more time and DOJ opposing any extensions of time.

Why would they set up a SCIF at the club of a private citizen without a security clearance? Especially one who illegally hoarded top secret documents?
You're so lost on this. He's toast, even with this bizarre MAGA judge playing goalie.
They have to provide some facility and it has to be reasonable in location and convenience to the defense. Putting one in the middle of Hunter's human trafficking lair in the Gobi desert doesn't work.Whistle Pig said:
They do not have to give him a SCIF at his residence for legal defense work, that would be quite stupid.
NARA has never set up SCIFs for classified documents or let former presidents keep them.
Have they ever set up a private SCIF for anyone accused of crimes involving classified documents?fka ftc said:Keep on whistling lil piggie.Whistle Pig said:

They HAVE to set it up because they accused him of a crime and he has a right to a defense.
Or they simply could have setup / kept in place a secure facility at M-A-L when NARA shipped all those documents to Trump or they could have provided for storage as they have done for every prior POTUS.
But you know this, it has been discussed on this thread and others.
Also, you know its not illegal for a former POTUS to keep personal AND presidential records from their time in office. The only illegal thing is to destroy them or otherwise make them permanently unavailable.
Sorry, maybe the Jan 6th, Bragg or Leticia will still get him for you.
