That doesn't make sense. We were told this was not a political attack against Trump and that the DOJ was reluctant to go after a former president, it was just going by the book.

I guess they must have forgotten to confirm if it was actually illegal for Trump to have documents before charging him for some reason...

I agree. I think our entire justice system should have biased judges for a while going forward. And the trick is to get your case before someone who holds the same biases. That way we won't be convicted of anything. But if you get one on the other side, its a guarantee.

Yep, this is were our country is headed, tit for tat. I'm sure it will stop after everyone agrees 'okay okay, even steven now'.

By the time they got through the appeal, she re-worked the scheduling order to reflect another procedure, and they got through that procedure, I can't imagine it would notably speed things up.

The only way the speed of this case were to notably accelerate would probably be if a winning appeal was followed by a winning effort at obtaining her recusal. (Edit-And I'm not saying she should recuse. I'm saying that's the only way the pace seems it would pick up.)

At least that's my view.

Since Smith has no case and Trump has several layers of defenses, I imagine the DOJ is in no hurry for any activity on this. They got their indictment, that's all that matters.

From the filings especially the response times it appears DOJ is in a hurry and Cannon/Trump are seeking every possible avenue to delay.

DOJ requested a December 2023 trial date.



Trump team did not suggest a date in this case other than "after the election" but requested a 2025 date for the DC case.

Then they probably should have kept the SCIF at M-A-L, had plans to setup a temporary facility for Trump and his lawyers before indicting, and probably should be using the civil procedures through NARA to determine the proper classification and storage of presidential records.

Instead, they fabricated a case, forgot to remove Trump's security clearance until someone brought it up, then removed it to add a hurdle for him and his defense attorneys, then continue to leak information to mislead poor misguided souls who think the DOJ and Smith are after the truth and justice.

Nah. The docket in this case is full of Trump asking for more time and DOJ opposing any extensions of time.

Article III judge has immense control over her docket. DOJ and 11th Cir are free to tell her to hurry up as much as they want but they're not going to get much traction.

Pure posturing. They don't want to hurry up. The only way they would be okay with hurrying up is if Trump pleads guilty and agrees to leave the country never to return.

Else, they would have moved mountains to allow for Trump and his lawyers to prepare their defense. So... me thinks if you believe the DOJ is trying to hurry, you may simply be complicit in the political persecution of Trump.

Its a sad look, particularly for people who claim familiarity with the judicial system.

They do not have to give him a SCIF at his residence for legal defense work, that would be quite stupid.

NARA has never set up SCIFs for classified documents or let former presidents keep them.

No, typically the DOJ is forthright in the types of documents that the alleged perp had in their possession, actual clarity about why the docs were not authorized to be in possession, and they typically have not coordinated with other departments in the executive to ship classified docs to a location that use to be secure, then one day say its not secure after the documents have been received, then visit the now unsecure location that has 24/7 surveillance and armed security and ask that the documents be moved to a room with a more secure lock, then leak pictures of hats and magazines and claim a crime has been committed by a former POTUS and current opposition to the sitting POTUS.

Nope, those things are sort of new here.
