I think they found another unpublished opinion from a different appellate district in Virginia which agreed that the cut off time is the cut off time. So it seems there are two unpublished opinions with differing views on the issue. I don't think they ever established which circuit this court was in, so not sure of the prevailing standard.

The judge has made every indication that she is going to cut them off.

On another note, but related, why did everyone seem to "turn" on Rekieta? They never even mention him on Legal Bytes. Some of them still show up on his daily broadcast, but did I miss something?

Nothing really happened other than Nick made them famous and they are making money doing their own thing. Just depends on the flavor and amount of the commentary you prefer. I usually have Rekieta, Legal Bytes and Emily D. Baker up in different windows and switch back and forth. But I stick primarily with Nick because he has Branca with him most days.

Speaking of which.

ETA: Ben Chew is making the motion Says there is no evidence Depp even saw Waldman's statements before he was served with the counterclaim. He was on the stand for four days and no one asked him that?

Chu is arguing a fact question that should go to the jury, because there is a dispute between witnesses about the events of May 21, 2016. He can lose this motion for that reason alone.

He'll probably lose anyway just because judges don't like to take questions out of the jury's hands. It was a crap counterclaim from the get go as vicarious liability as to Depp anyway and it should have been dismissed for that reason before. But now the waters have been muddied a bit.

Based on what I am hearing, this judge could have made this trial much cleaner by ruling on some of these motions earlier. I was confused why some of these questions were still being discussed, i.e. agency, etc. It sounds like the lawyers filed the motions, but the judge denied them.

OUCH! This guy is hammering on Heard's acting and her lack of chemistry had to be "fabricating" in post production. Some movies are easier than others but hers was particularly difficult.

Yes. It has taken a tremendous amount of time out of court to negotiate portions of testimony over objections and get the editing done. Very unusual to see this many depositions shown in court.

This judge held Fridays open for just that purpose as the judge would watch them, rule on the objections and then the parties stipulate what they want to come in.

Because of the inability to subpoena out of state witnesses under Virginia law, many of these depositions were conducted as trial depositions as opposed to discovery depositions. Meaning the lawyers would put their objections on the record during the deposition for the judge to rule on later before introduction at trial.

Rottenborn on cross of the plastic surgeon.

Still a plaster cast is his point, although with softer sides to account for post operative swelling. But Depp's other hand was fine. Rottenborn shows pictures of Amber's closet that Depp tossed and was asked if the cast would have prohibited Depp from doing that. Doctor says he had his other hand so no. LOL.

As a lay person, it really pisses me off that lawyers think the jury is stupid. This entire cross was a bunch of shallow, easily poked arguments that defied common sense and insulted the intelligence of the people listening.

The Heard expert's analysis "wasn't worth the paper it wasn't written on." That was a big takedown. These Depp experts have been fire but good at communicating it.

You've never been an expert witness in a case of a female actress suing for potential lost wages as a result of defamation, have you?

You aren't testifying as a defamation expert, right?

Mr. Vanya is back on the stand. Social media analytics guy to rebut Heard's expert, Schnell, about use of the hashtags into defamation from the Waldman statements.

Now here is where Heard's team kind of messed up by calling those expert witnesses last. The rebuttal is more effective since the opposite testimony is so fresh in the juror's minds. Assuming they were paying any attention yesterday.

Demonstrative evidence is strong here. It appears the majority of the negative Amber Heard tweets occurred before the Waldman statements. He has it laid out in a graph. The Waldman stuff is a tiny little spike.
