Mornin' all. Pretty tired and my coffee isn't helping yet but I'll soldier through in honor of Veterans Day. Thanks to all of those who have served!

Okay, after the riveting events of yesterday, today should be a bit less dramatic, unless Binger has another slap fight or two with the judge. Saw Turley on Hemmer a bit ago and he was apoplectic about Binger's prosecutorial misconduct thus far and said he wouldn't be that surprised if the judge dismissed today because of it. In his experience, many judges would come to that decision.

I doubt he does so...yet.

Branca has posted a long piece about the gun charge against Kyle and the ambiguity of the law. Even worse is the ambiguity of the standard jury instruction that actually ignores part of the statute. That analysis is HERE.

My understanding is that the defense will a use of force expert, Dr. Black as their first witness today, although I have seen reports that perhaps Kyle might be on the stand again today. I think those are wrong unless there were some late night events that I haven't seen reported.

Binger or Kraus for that matter may have a very hard time today because Dr. Black is apparently a very experienced expert witness on use of force. I am not familiar with him but some of the lawyers on the Rekieta feed apparently are.

Did they file for a mistrial with prejudice yet?

Most of them aren't this interesting.

I've been on 2 for speeding tickets and was first in the pool for a traffic accident. Odds are it won't be much fun.

Pretty sure Armstrong testified that enhancing added pixels. Not quite pinch and zoom, but Binger is going to lose that argument.

You know how they all keep making a big deal of Kyle Rittenhouse driving all the way from another state to Kenosha, which his travel was only 21 miles?

I wish they'd make a bigger deal about Gaige Grosskreutz who was from Glendale WI that was 45 miles away, over twice as far as Kyle and Gaige Grosskreutz has no locals ties to Kenosha. Kyle has his father and aunts and uncles and his Grandmother that all live there and Kyle worked there as well.
