Mornin' all. Pretty tired and my coffee isn't helping yet but I'll soldier through in honor of Veterans Day. Thanks to all of those who have served!
Okay, after the riveting events of yesterday, today should be a bit less dramatic, unless Binger has another slap fight or two with the judge. Saw Turley on Hemmer a bit ago and he was apoplectic about Binger's prosecutorial misconduct thus far and said he wouldn't be that surprised if the judge dismissed today because of it. In his experience, many judges would come to that decision.
I doubt he does so...yet.
Branca has posted a long piece about the gun charge against Kyle and the ambiguity of the law. Even worse is the ambiguity of the standard jury instruction that actually ignores part of the statute. That analysis is HERE.

My understanding is that the defense will a use of force expert, Dr. Black as their first witness today, although I have seen reports that perhaps Kyle might be on the stand again today. I think those are wrong unless there were some late night events that I haven't seen reported.
