Not a good idea to file a police report on yourself.

As per filing charges for false report, not worth the effort to pursue because only harm done was to his own reputation which he did to himself.

If Isaih cooperates and reveals who wrote the notes...it would be a good opportunity for him to make amends.

What happens to Isaih is up to university officials.

As far as who wrote the notes, right now it is hearsay and can't be proven without a witness.

Surprisingly to some folks, leaving racially insensitive notes on someone's car, not in their presence, and without doing damage, probably isn't a criminal offense. Without a threat to violence, damage to property, or the prospect of an immediate breach of the peace, the alleged victim's story, even if true, probably would not have been a crime.

Therefore, his filing a false report regarding this non-crime does not fall within the coverage of the false report statute.


Fair enough.

Where does providing false information to a law enforcement officer fall in the spectrum of crime? For example, if they asked him, "Do you know who made these notes?" And he replied "I don't know" but he actually knew and the police could prove it, what would happen then?

I don't think the police can prove who made the notes, but I suspect they reminded him lying to the police comes with a penalty. At that point he stopped talking with them.

One thing that has bugged me that I haven't seen mentioned in this was about the dog walker accusation. How are we to assume how the dog walker knew that the car belonged to a black person? I'm assuming there is a bunch of cars in the parking area and this guy supposedly walks up (with paper and a sharpie while walking a dog no less) and just happens to pick out a random car he assumes is owned by a black guy?

Seems like an extremely implausible scenario.

If you make a sworn statement (something that an officer will probably ask for before proceeding with a formal complaint against a named defendant), then you risk perjury. Absent that, I think Section 42.06 of the Penal Code is the only thing that might apply, and, as mentioned, this wasn't a report of an "offense", nor was it a bombing, fire, or other emergcy.

If someone wanted to really go after someone, fake hate crimes might fall under attempts to incite violence or unrest, which would make it an emergency.

Protests on campus... nationwide rioting... an epidemic... Sully defaced the week before...

There's a reasonable case to be made that fake racist notes could be trying to incite a call to violence.

To be criminal probably requires :

1. You have filed for and received a civil harassment restraining order (not sure if TX has that specifically - it might be a check box on an application for protective order).

2. A named harasser in the restraining order.

3. A violation of the order after it has been signed into affect by a judge and served to the named respondent.

Otherwise freedom of speach.

I googled PWI last week as I was not familiar with the term

AS far as I can tell it was a term generated in critical race theory discussions to identify as the names says, predominately white institutions

I am not convinced by the "handwriting" analysis (other than finding it interesting, it's certainly not a slam dunk), but I am convinced Isiaih put those notes on his own windshield, so he knows who wrote them.

Y'all totally misread the main motivator for most of this stuff. Victimhood is popular. Being a victim of racial injustice is a status symbol and gets you attention, especially in the "all-important" world of social media.

It's not nearly as much about hate as it is about insecurity and narcissism. The "hate" just kind of becomes acculturated as a byproduct of the pursuit of victimhood.
