It's not premeditated, no matter how much you try to pretzel your logic. Officers in the act of restraining someone have much more legal lattitude here. It may have been a wrongful killing, it will never be murder. By definition.

Do you think you have to have planned it in advance for a killing to be murder? He intentionally shot that unarmed man in the back. Multiple times.

That's not how the term murder is used legally though. That fits for first degree murder charges, but second degree murder charges do not have to prove premeditation.
