I do understand what everyone is saying about the girl did work at the business. I understand this and agree with this. What I am saying is that, the law is the law. If the property owner's agreement with A1 is specific about needing a list, then legally it doesn't matter. They didn't have a list and thus it was towed.

I am not saying anything about the way it was handled after the fact. I am 100% in agreement that once it was proven that the girl worked for Schlotzky's and the manager made the call, they should have towed the vehicle back to her. This is the PR disaster that went on, but the legal end seems cut and dry, GIVEN the agreement calls out for a list by the businesses.

If the tow did violate the law, then the vehicle owner has the recourse that I posted above.

I am not trying to be a "troll", whatever that means, since I am not savy to some of these internet terms, but am just stating my opinion, strongly I must admit, of the incident.

I just wanted to post here on the GB instead of MYBCS, as I want to become part of the family here. I know it takes a lot to be accepted here and not get booted back to MYBCS, so give me a little bit of a break.

AND... maybe I could get a "get out of storage free" card or a "we'll tow your car back to you for free" card from A1 in the event that I was towed someday.

OK... just kidding about that, but I wanted everyone to know that I do have a little bit of a humorous side too, despite all the seriousness people have seen of me here.

By that logic, every customer must inform the property manager of their vehicle so they can be put on the list prior to going into the business. Correct?

I sure glad bradleyk went into the profession he did and not the practice of law...just citing statutes doesn't mean the tow was legal.

If a person (employee or patron) goes into a business on the property then there should be no tow of the vehicle.*

* as long as the person does not leave the establishment and go about business off premises

Also, it would be important to see what exactly the lease between the business and the lot owner says happens if the "list" is not provided.

Well, as a matter of fact, it is private property, so the property owner can do whatever he pleases.

Maybe they should put up parking attendants to verify a receipt of $5 or more or else you pay $5 to exit.

I don't know the best way for them to control the parking over there... I am just saying that Schlotzky's knew better and knew how to prevent this. There are actually a lot of details we don't have, like the contract between A1 and the property owner, any agreements between the property owner and the businesses, where the car was actually parked, where the spotter was located, and on and on.

My OPINION is only based on 3rd party information (TxAgs and MyBCS) and the Texas statutes and again is just merely OPINION.

I wish we had all the facts to look at. I would love to see what really happened here and how this would be tried from a legal view.

In the end, I feel there is some responsibility to be taken by A1, the property owner, the spotter, and Schlotzky's. Seems they have all made errors and YES, a poor working girl suffered the consequences. It just isn't fair to blame the tow company and the spotter only, when the other 2 parties have some hand in this also.

I really wish someone would drive their truck over to the lot and set up an "A-1 Spotter, Spotter" stand, Kinda like the list eater watchtower. Just sit up there with some food and drink purchased from one of the business (support schlotsky's) and keep a look out for everyone (complete with binoculars).

If I were still in school I would do it.

bradley, you seem like a nice, earnest fellow, so I'm going to advise you to reconsider your desire. We are like a family, but we're the relatives you dread seeing at family reunions. AAB, I did google it and it made no reference as to how a tow company could tow a vehicle with no keys without causing damage to the vehicle by forcible entry or damaging the shifting mechanism?

depending on the car and if its front or rear wheel drive, the wheels can still move when its in park and the brake is off.

So if its a front wheel drive. secure the front end, release the handbrake, and roll on down the road.

four wheel drive cars require a flatbed or go jacks to get going.

Go-jacks are basically giant roller skates for cars. They go around the wheel and the raise it to lift it off the ground. Then you can move it like a shopping cart
