They had to go pick there car up from north Bryan and were left without the use of it overnight.

So yes they paid. A1 should give the victim damages.

The owner of the vehicle was still denied access to their property by a company that had no right to take control of it. That is a major issue.

jh, the spotter had no reason to believe that it wasn't a legal parking job. They didn't keep their eyes on the vehicle the entire time if they didn't know another person got out. Therefore, the situation is compromised and no tow should occur.

You would have been better off pretending that you were trolling.

I never said that the spotter wasn't at fault. I was just making an observation that the company had to have believed that they were right at the time of the tow. Once it was proven otherwise, the vehicle should have been returned. More than anything, the employee of the towing company should have never let this get blown this far out of proportion on an internet message board.

Whether the company believed they were right at time is not relevant.

The spotter (an employee of the company) did not apply due diligence removing any aspect of the company acting in good faith.

Should, but what is your basis for damages? 12 hours without the vehicle at $7.75 / hour?

You should take the case on contingency. 40% of $93 wouldn't buy you a nice dinner.

A1 should be compelled to make the owner whole in the matter.

Without such a counterbalance there is a tremendous incentive for A1 to "err on the side of tow" since the system, as it stands, is rigged in its favor.

maybe A1 should look into getting business from AAA or USAA or one of the other emergency roadside assistance companies.

I'd say $100 would be fair. I'm not saying it should go to court, but people should be held responsible for their misconduct. The best way to hold them accountable in a situation like this is $$$.

couldn't agree more with this.

and i thought i saw somewhere earlier in this thread the owner got their car returned without paying.

A1 towed my truck in college for parking in the office parking area of Saulsalito Apartments (my fault). A day or two after I got my truck back, one of the tires had gone flat and had to be replaced. Turns out they put a slow leak in the side wall by scraping it against the curb when the pulled it out. Was too late to do anything about it by that point though.
