"Although the district court's injunction applies only to plaintiffs and certain other specified
persons, the Department has determined to exercise its enforcement discretion to create greater
uniformity, consistent with the Attorney General's statement today. Consequently, effective
October 9, 2026, ATF will no longer require individuals to seek ATF approval under the NFA
before making or transferring short-barreled rifles, short-barreled shotguns, silencers, and "any
other weapon" as defined in 26 U.S.C. 5845(e). ATF will also no longer require such items
to be registered in the National Firearms Registration and Transfer Record. These policies apply
uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the
litigation."

So a trust is no longer needed, but do I legally need to transfer the items from my trust back to myself as an individual if I want to get rid of the trust?

Any benefits to keeping the trust?

Yes- in my (attorney's) opinion - you should put your firearms in a trust so that they are not subject to public record probate upon your death.

There's no ownership records for 99% of my firearms.

What's to say that the trust I have doesn't already own them?

Scheels (Montana) is still requiring form 4 due to state constitution.

Said things could change once they get more clarification, but anything purchased this weekend will require form 4.
