Gotcha. I thought the seven days applies to the appeal also. Does it become nationally applicable if the appeal deadline comes and goes in October?
So yeah, this is set up to be a cluster however...
...what if that's exactly the point? Behind the scenes agreement to make such a huge mess that DOJ has no choice but to concede?
ATF would be enjoined from enforcement nationwide against the named entities. Gotta check your state law as well, though.
If the ATF lets the stay lapse, I don't see how they don't just abandon registration entirely. All other companies then IMMEDIATELY have what - monopoly, due process, equal protection issues? This sounds like a Con Law final or a bar exam question. What a damn mess.
Silencer Shop and GOA customers/members would have a field day buying SBRs and suppressors. Everyone else is not going to sit by quietly. Also, how is ATF going to figure out exactly what suppressor is Silencer Shop? Cop walks up - "it's a Silencer Shop can, bro!" Wife threw away the receipt. Also, wjould it only apply to members of GOA at the time of filing? If not, then you just have to sign up for GOA when you buy your can or SBR.
Unless they are going to stop putting serial #s on them, won't be hard to figure out.
That's true. But if the original owner bought from Silencer Shop then the # is a "good" one. Is serial numbering requirement a separate law still intact for future suppressors? I don't know. If no serial #s, then game over.
🚨 BREAKING: I’ve received confirmation from the Trump Administration that the DOJ will NOT appeal our historic court victory against the NFA.

THANK YOU, PRESIDENT TRUMP and Attorney General Blanche, for delivering the most significant Second Amendment win in OVER 90 YEARS!

Yes...lawyers stop on in and update us!
From my understanding on this you could also sell a pre-owned suppressor private party to private party like you can a firearm in Texas.
The biggest change to silencer laws in 90+ years.

Starting tomorrow, August 13 at 12:01 AM, silencers and AOWs gotten through Silencer Shop can transfer with no Form 4, no federal registration, and no wait.

GOA, @SilencerShop, @TheAKGuy, & @WesVirdellTX have officially notified ATF & DOJ of our intent to transfer suppressors tonight, at 12:01AM CDT on 8/13/26, without complying with the currently enjoined requirements of the National Firearms Act of 1934. https://t.co/iyr4teQtN9 pic.twitter.com/iYEbbcryMo
I'm curious how this will affect my suppressor that is currently on order from Silencer Shop. Right now it's waiting on the dealer signature on the ATF paperwork...
Quote:
& RECENT COURT RULINGS As many of you are aware, yesterday marked the deadline for the ATF to appeal the recent court ruling regarding suppressor transfers. You may have also seen recent media (including content from Silencer Shop) demonstrating silencer
transfers completed via Form 4473 alone.
Where Things Stand: As of today, the ATF has not issued official guidance or formal procedures for
FFLs/SOTs to follow under this ruling.
Our Policy: To protect our business and ensure our customers remain fully compliant with federal law, we will continue processing all silencer transfers through the standard Form 4 process until official,
written clarification is issued by the ATF.
"Buy & Hold" Option Available: Want to secure a suppressor before inventory shifts? We are offering a Buy & Hold option. You can purchase your silencer now,
and we will hold it in inventory
while we await official AT guidance on transfer procedures.

I've been loosely following this, but great news! I only see GOA members mentioned, but are 2nd Amendment Foundation members also included in that group? Became a member with them back when the pistol brace fiasco was going on, hoping I'm included in this win as well.
