Interesting that someone is trying when most shops are waiting to see what happens. I've only seen a few in social media that are going ahead.

I have one waiting on ATF approval from silencer central submitted July 27. Hopefully that keeps chugging along as normal and I get it soon.

From the Texas State Rifle Association (TSRA):

The ruling involves two consolidated cases: Silencer Shop Foundation v. ATF and the NRA-supported Jensen v. ATF.
The injunction protects the named parties and, where applicable, their agencies, political subdivisions, current and future members, and current and future customers.
The Jensen plaintiffs include:
  • Texas State Rifle Association
  • Citizens Committee for the Right to Keep and Bear Arms
  • FPC Action Foundation
  • Hot Shots Custom LLC
  • Several individual plaintiffs
Because TSRA is a named plaintiff, its current and future members are included within the injunction's language where applicable.
More info at the link: TSRA News release

ATF and the Department of Justice have not issued complete guidance explaining how covered dealers and purchasers should document or complete transactions under the injunction.
Important questions remain regarding:
  • Required federal forms and background checks
  • Dealer acquisition and disposition records
  • Verification of membership in a protected organization
  • Trust and legal-entity purchases
  • Dealer transfers of SBRs and SBSs
  • Special Occupational Tax requirements
  • Interstate transportation of SBRs and SBSs
Until binding guidance is available, purchasers, manufacturers, distributors and dealers should proceed carefully and obtain qualified legal advice before relying upon the injunction.

Judge's 'historic' ruling topples decades-old gun restrictions: 'Unconstitutional' | Fox News

"GOA said Brandon Herrera and Texas state Rep. Wes Virdell acquired the suppressors from Silencer Shop in Leander, Texas, in what the gun rights group called the first lawful transfers without National Firearms Act registration since the law was enacted in 1934."

Brandon, as you know, is running for Congress.

"Previously, this would have been punishable by up to 10 years in federal prison and a $250,000 fine per violation."

I think I would have waited a few weeks to see what the ATF does - do they appeal? If the ATF wins, will they go after Brandon?
When the truth comes out, do not ask me how I knew.
Ask yourself why you did not.

I'm sure this was all carefully planned, they are aware of the risks. This step was needed to test the waters and push boundaries.

They are playing offense for us instead of sitting back on defense.

I'm not familiar with the Silencer Shop in Leander. Is that the corporate office only or does it have a store there also?

If you buy from Silencer Shop, reminder to go to silencershop.com, login and click the button with the circle and person to call up your dashboard. Make sure everything is green/good. You can track your progress there too.

(if you don't have a guy willing to sell w/o a Form 4).

I had a new suppressor approved this morning. 40 hour turnaround on the Form 4. I definitely wouldn't wait on the dust to settle if you currently have a shop that wants to keep using Form 4s right now.

First, I think that suppressors being NFA items is dumb and they never should have been on the list. So, the recent court decisions makes me happy that we are moving in the right direction. I have suppressors and use them regularly.

My only question is the court case specifically addressed these items are unconstitutional basis taxing. What is to stop a future administration from coming in an increasing the tax for these items ? Wouldn't that mean we are back to where we started ? Could be a dumb question but what am i missing ?

It is not their corporate office and not a store. For whatever reason, they are not doing the 4473 there and that is why all of the suppressors purchased are being sent to Watermark

Nevermind. I did a bit more digging and found that it only applies to previously purchased firearms for the time being. So will have to wait and see if there is a rule change for SBRs.

Any update on this? Talked to my ffl shop and they said they are not doing anything at this moment. They are waiting for further guidance. They said if nothing comes pretty soon they will just go back to what they were doing before this court decision. I am trying to buy my first but don't want to be caught up in any nonsense.

If you want one, just buy it. I keep seeing folks are getting their form 4's in a couple days. It could be weeks or months before there is a guidance issued.

I bought one through silencer shop a few days before all this went down. My FFL is still requiring a Form 4. I think due to everything going nuts it sat a week waiting for the dealer to submit it. It finally got submitted 8/18. We'll see how long it takes to approve.

I thought they had moved their retail site from 183 and 620 area, up to 183 near Liberty Hill in the fall of 2025? I was about to buy a suppressor at the time from the old location and they had stopped all sales until they could get relocated.

I got mine in days. Even with a gun trust. Make sure you go to the Silencer Shop website, log in, and check your information. My picture was "out of date" so they hadn't submitted it yet. When I fixed it, they did and it took 2-3 days.

Edit: Haha. Oops already posted that before. I'm had total knee replacement surgery today and am on Oxycodone. You might see more multiple or weird posts from me. Sorry, excuse me while I kiss the sky.

Just received mine in the mail from silencer central. Took less than a month from starting process to at my front door. Also realized I'm glad I did mine in the old process just so I have no issues taking it to Colorado and new mexico for hunts this year.

The thing that becomes apparent is this is a messy cluster F.

So we just have these set of felony laws out there and probably most lawyers or judges don't even know what the hell is legal or not.

The way out of this is to call your State and Federal Congressmen. Repeal the NFA.

I am still waiting on my suppressor. As of last Thursday it was still waiting on the Form 3 transfer paperwork to move it to the FFL. I am not sure this isn't a ploy by ATF to slow roll suppressors purchased after the court ruling. Silencer Shop originally told me 3 days to 1 week max.

IF (please note "if") the ATF is keeping a database of gun owners / gun purchases, some hotshot lawyer needs to sue the crap out of them.

The ATF is allowed to and does keep a database of NFA items (SBRs, full auto, suppressors, etc.). They are not allowed to keep records of normal firearm purchases from background checks, etc.

Yes, I'm sure the agency who promoted the guy in charge of running guns to the cartels to make American gun stores and owners look bad is very, very concerned with what they are allowed to do by law.

Theres no way they are keeping records illegally.

That would be unimaginable.
