I have one waiting on ATF approval from silencer central submitted July 27. Hopefully that keeps chugging along as normal and I get it soon.

From the Texas State Rifle Association (TSRA):

The ruling involves two consolidated cases: Silencer Shop Foundation v. ATF and the NRA-supported Jensen v. ATF.
The injunction protects the named parties and, where applicable, their agencies, political subdivisions, current and future members, and current and future customers.
The Jensen plaintiffs include:
  • Texas State Rifle Association
  • Citizens Committee for the Right to Keep and Bear Arms
  • FPC Action Foundation
  • Hot Shots Custom LLC
  • Several individual plaintiffs
Because TSRA is a named plaintiff, its current and future members are included within the injunction's language where applicable.

ATF and the Department of Justice have not issued complete guidance explaining how covered dealers and purchasers should document or complete transactions under the injunction.
Important questions remain regarding:
  • Required federal forms and background checks
  • Dealer acquisition and disposition records
  • Verification of membership in a protected organization
  • Trust and legal-entity purchases
  • Dealer transfers of SBRs and SBSs
  • Special Occupational Tax requirements
  • Interstate transportation of SBRs and SBSs
Until binding guidance is available, purchasers, manufacturers, distributors and dealers should proceed carefully and obtain qualified legal advice before relying upon the injunction.

Brandon, as you know, is running for Congress.

I think I would have waited a few weeks to see what the ATF does - do they appeal? If the ATF wins, will they go after Brandon?

I'm sure this was all carefully planned, they are aware of the risks. This step was needed to test the waters and push boundaries.

They are playing offense for us instead of sitting back on defense.

I'm not familiar with the Silencer Shop in Leander. Is that the corporate office only or does it have a store there also?

I had a new suppressor approved this morning. 40 hour turnaround on the Form 4. I definitely wouldn't wait on the dust to settle if you currently have a shop that wants to keep using Form 4s right now.

First, I think that suppressors being NFA items is dumb and they never should have been on the list. So, the recent court decisions makes me happy that we are moving in the right direction. I have suppressors and use them regularly.

My only question is the court case specifically addressed these items are unconstitutional basis taxing. What is to stop a future administration from coming in an increasing the tax for these items ? Wouldn't that mean we are back to where we started ? Could be a dumb question but what am i missing ?

It is not their corporate office and not a store. For whatever reason, they are not doing the 4473 there and that is why all of the suppressors purchased are being sent to Watermark

Nevermind. I did a bit more digging and found that it only applies to previously purchased firearms for the time being. So will have to wait and see if there is a rule change for SBRs.
