There was a withholding order in place from 2019 saying he could not be deported to El Salvador because he was fearful for his life or something like that. The Trump administration did not appeal it and released him. I think he even got a work permit at that time.
He was mistakenly deported to El Salvador due to administrative error because they failed to get that withholding order lifted before deporting him. His gang membership would have been sufficient to get that done.
So once that order was gone, they could deport him.
The Trump position is that despite of the administrative mistake, the court lacked jurisdiction to hear the habeas case because he was already gone. The US attorney was fired for not zealously advocating the lack of jurisdiction position at the hearing in district court.
