I disagree with you on our judicial system. The problem is bigger than that. It would reflect on our entire society in our country. And that has reared its head for decades but seems like a much bigger problem now than ever before.


Agree. You have an entire segment of this country that thinks the rules don't apply to them. From looting during natural disasters, to rioting over things they don't agree with, to something as simple as not being a garbage human being on a flight or cruise. Race relations have gone straight down the crapper in my lifetime.

I hope I'm wrong too - the Metcalfs deserve justice. But I think there are so many outside elements to this case that the jurors will say "we can satisfy both sides somewhat with a guilty verdict but not one so harsh he is in jail for 50 years."


I hope the jurors are smarter than that. 50 years isn't harsh, Austin Metcalf didn't even get one more day.

In reality, prisoners that aren't lifers aren't going to risk parole/time credit.

Even for the ones that are lifers, prisoners get tablets now, and no one wants their tablets taken away. They have been pacified the same as a noisy toddler at a restaurant.

Not saying he won't run into a little trouble here and there, but this Oz-esque fantasy of him being constantly assaulted simply isn't what's going to happen.

My understanding of self defense is that it must be disproven before moving to charges, so it wouldn't make sense to put it after. Maybe I'm wrong but the wording of those charges makes it seem like it was never a consideration

He'll get himself in a bind with his own people far quicker, especially if the money stops.

You have that reversed. They only consider self-defense after they have decided State proved murder beyond a reasonable doubt.

We spend too much time these days trying to satisfy both sides instead of doing what is right. Its the reason we are in the shape we are in. Schools, governments, churches corporations all do it. And if courts do it-- we have no hope for our country.

They will then "immediately" start with the sentencing portion of the trial after a guilty verdict. Prosecution calls witnesses, etc.



"Immediately" doesn't mean necessarily right then. The judge may take a few hours break or let them go home for the day. It all just depends. But it won't be next week or anything like that.

Assuming sequestration was not waived, they will start deliberating and food will be brought to them.

Do defense attorneys "prepare" their clients facing long prison sentences in any way? Obviously they are there to help their client win, but do they coach them on what to do if found guilty and what happens next when facing decades behind bars?

In the one big felony jury I was on, the lunches were very good. Judge Westfall took care of her jurors.

Kind of random, but is it possible the defense did not have KA testify in his own defense because they anticipate a guilty verdict and would rather save his words for a meaningful apology/allocution during the punishment phase?

maybe? But most likely is simply that most blue collar defendants are too stupid not to say anything stupid while on the stand.

That trait is also common amongst white collar defendants as well.
