I'm not sure if he formally ruled on their motion to dismiss after the State rested, but that would have become moot after he sent the jury to deliberate, and further moot when he denied the defense's Motion for a Judgment of Acquittal from the bench on May 30.

INCORRECT as to the Bold.

The Statute specifically contemplates the Judge reserving decision o until after the verdict has been rendered and accepted by the court.

I do agree on the denial of the motion for judgment of acquittal effectively making it moot, Merchan is still going to "formally" deny that motion in the docket.

Team Trump will likely file a formal motion under 290.10 (or some other rule) by the 6/13/24 deadline.

Fair enough. You're correct. The Court can wait until after a guilty verdict because ruling before the guilty verdict prevents the state from appealing the Court's ruling.

Nevertheless, its essentially moot.

I think its normal pretty much everywhere to have a presentencing interview for felonies.

And of course he'd have a probation officer if he's put on probation

Right, so he lied when he said he would rule on it. He never considered it. He was never going to consider it.

I can't wait to watch heads explode when Trump tells Netanyahu he'll have place him on a brief hold since his PO showed up unannounced.

I guess the voice in my head didn't translate to the keyboard well. I have stated this trial is a purely political farce that should never have happened. I meant liberal heads popping when future President Trump is still on parole. It was a jab at all these "objective" guys who think this trial was by the book.

NJ getting into the lawfaring action. Since Trump was convicted of crimes of "moral turpitude", it's unlawful for his businesses to have liquor licenses now.

They'll never stop until the right does it back to them. It's a one-sided fight. The right has to join in.

...and they are already squealing like pigs knowing Trump is likely to be re-elected.

Quote:

The three-letter agency officials turned CNN puppet told Kaitlin Collins that intelligence community members are spanking because they are worried Trump will prosecute them for their participation in several hoaxes, such as the "Russian collusion" lie, and falsely labeling Hunter Biden's laptop from Hell as "Russian disinformation" before the 2020 election.

"It's terrifying. It's frightening," McCabe said.

"The former assistant director pointed to one of Trump's rally quotes in which he claimed he will be 'retribution' for disenfranchised American voters, predicting that it will culminate in "really dismantling and greatly incapacitating the Department of Justice and the FBI," he added.
Yes please.

Dumb question...

But those licenses have been issued to a corporation for facilities, and not to an individual. Unless they are in his name, which I'd highly doubt, isn't this a silly exercise?

I don't know New Jersey, but in Texas, a liquor license is given to a "person." For a corporation, this flows through to the officers and majority owners. In other words, those individuals are ultimately responsible for the license and they're really the ones obtaining the license, albeit in the name of the company they run.

And Texas can deny or revoke a permit if any of those persons have certain issues, including felonies or issues of "moral turpitude."

I'm not saying New Jersey is right to call this a crime of "moral turpitude", I don't know their rules and their laws, but I bet their law is similar at least in the sense the permit attaches to individuals.

No, he had a long back and forth about it with both parties and then reserved decision. As Gipper pointed out New York law specifically contemplates that and I suppose he'll formally rule at some point on that motion or a renewed, written motion.

It essentially became "moot" because the motion for acquittal made after the verdict was made on the exact same grounds and was denied from the bench.

My point is, if the defense wants to appeal the Michael Cohen credibility issue, they already have a denied motion for acquittal upon which to do so.

From what I remember that is correct, my wife and her sister were named along with their father for his restaurants' liquor licenses.

Of course this is just disgusting over-reach again.

TBH, the most impressive part of the closing was that the DA lawyer seemed to have the massive slide deck entirely memorized.

Yes, it does. He wasn't at the computer or operating the PowerPoint, as the transcript and reports said he was directing someone else who was doing all of that for him
