Ethical prosecutors would not even think about using evidence that they know has been improperly gathered nor tampered with in any manner. Where's the chain of custody here? That should denote who tampered with those documents.

And of course what Jack Smith is referring to as "classified documents" is documents that were ever marked as classified. If they were declassified by Trump, he's still calling them classified.

As Andy McCarthy pointed out recently, Smith could have simply brought obstruction charges against Trump instead of espionage bringing the CIPA into play. Smith overcharged this case and most of the current problems with his prosecution were and remain self-inflicted.

Then again, Smith has a penchant for overcharging.

I'm just thankful that we have a normal judge presiding over this and not a Merchan or Engoron type.

I think it is all about making it as sensational as possible to make Trump look as bad as possible. Of course, that is why they have illegally leaked to the press, why they raided MAL, and why they staged the propaganda photos. Idiots lap it all up.

It's why I use the George Costanza driving all the way to the Hamptons analogy. The Biden administration/Smith could just come clean now and admit this is a political stunt. Or they can keep it up until they get to the Hamptons and have to finally admit there's no house.

No. If Andy McCarthy said that, he's full of it. "Obstruction" of an investigation into whether he's retaining classified information would bring the classified information into evidence, and there's no chance Trump's lawyers wouldn't be making the same CIPA arguments as they have been.


Besides, most of the motions and most of the delays in the case haven't had anything to do with CIPA.

I have heard about these "ethical prosecutors" you speak of.

I've seen some on old tv shows; and I suspect on new tv shows if I ever watched those kinds of things anymore. I honestly think there's a small section of the Dem party who would gladly send the "undesired" to Leftorvo prison for a little torture and execution.

That behavior from a US prosecutor is obscene. The very worst part of this is he wont suffer any consequences. From what I can tell, a lot of "peer judges" are trying to get Cannon in Florida to recuse herself.

IF that action were to occur, I'd have to admit Smith/DOJ has a shred of integrity, and like Weissman before him, he has absolutely none.

However, at this point, with no trial before the election (and probably not until after the inauguration), he's just trying to get Trump's legal fees over $100 million.

The last amount I heard was fees were at $77 million two weeks ago.

While several of the trials have watched live streamed had some very bad prosecutors in that they don't follow the rules nor the orders of the court, the others have been much much better, brilliant in fact. The Waukesha Christmas Parade trial of Darrell Brooks was damn near flawless presentation by the prosecution team. Same with the Edgecomb trial.

The two worst prosecution teams OTOH were both in Judge Schroeder's court in Kenosha. Rittenhouse and Zachariah Anderson. The jury in Rittenhouse saw through the state's bluster and tricks. But not so in Zach's trial. The prosecutor in Zach's trial was the boss of Binger and Krauss from the Rittenhouse trial. So that DA's office rotted from the head just like a fish.

I don't think the CIA would try to overthrow Trump for no reason, there is a much bigger cover-up at play and it circles back to Russiagate and the spoof of the DNC hack. Obama turned loose the full power of the intelligence community against a candidate that every expert and pollster said was going to lose badly. Obama slapped down his own VP to install Hillary in the Oval Office to carry on the mission of laundering billions in tax revenue and destroy the American economy to put the working class on the government till so they can be controlled. Trump blew up that plan and they've been after him since.

Harbach again had a bit of a temper tantrum at the end of the hearing. He asked to give a brief rebuttal to Bove's closing comments--Cannon gave him "30 seconds."

One day after admitting the special counsel has a "permanent, indefinite" source of tax dollars to fund both prosecutions of Trump, Harbach complained the proceedings were "unfair."

He accused the defense of "hijacking" the hearing with "repeated attempts to import" false allegations into the case about the MAL raid.

Cannon cut him off, basically saying no one is hijacking the hearing because it is over.

My guess is there will be a delay of at least a few weeks until the next hearing. Holiday week next week then Trump is set to be sentenced on 7/11 on NY case and the GOP convention is the following week.

Cannon is very mindful of everyone's schedule and making sure defendants can fully participate in the proceedings.

Looks like she'll deny this motion but 2 biggies are on the horizon: A rescheduled hearing on the scope of the prosecution team (collusion btw NARA, DOJ, and the Biden White House) and motion to dismiss due to spoliation of evidence siezed at MAL.

Hard disagree, especially after they submitted pictures of those cover sheets as evidence. If the sheets matched the classification levels of each document exactly and were serialized to match to the documents then sure, it's a no harm no foul situation. But they didn't match them to the documents, they just put top secret/ classified cover sheets on a bunch of documents and presented that to the court as if they were top secret/classified.

That's not what they did. Nor is that Trump's argument, by the way. Trump's argument is they don't know where or in what order they found the documents, which is why the Government explains in that response how they handled the documents.


They removed documents when the document had classification markings and replaced the document where they found it with a corresponding cover sheet that had the document title, classification markings, description of subject matter and other identification information. (This is in the motion, read it, don't depend on Julie Kelly to tell you what it says)

They then put a cover sheet on the actual document, put the document in the box top, and then took a picture of the document next to the box it was pulled out of. (Example here: https://www.courtlistener.com/docket/67490070/644/8/united-states-v-trump/


They're not hiding this, they're putting in public filings. They've said much of this before. And this isn't evidence tampering.
