In a mistrial situation, if there is a re-trial, can the prosecution introduce new evidence like the CVS video that this judge didn't allow?
Everything would start over. New pre-trial hearings, etc.
Interesting. I know the chances for a retrial might be slim but the ADA may think he can get new evidence admitted if its a different judge (or would this judge also do any re-trial)?
Not the ADA's decision on retrial. It is the DA's decision. This particularly DA likes to try cases himself, especially big cases. He ran away from this one and assigned it to Binger and Krauss, who then proceeded to commit every prosecutorial sin and no-no in the book.
Do DA's offices ever farm out prosecution in cases to someone with more expertise?
If Binger and fatty are the best they have that is concerning if I was a Kenosha citizen.
The DA hires ADAs as far as I know. The people elect the DA. They don't like it, they need to elect someone different.

I get that. I am just wondering if DA's hire someone for specific cases where the attorney might have expertise.
Was Rosenbaum really as tiny as that photo makes him look or is it an illusion based on the horrible photo zoom? He looks like a meeple.
Just a little yippie dog. Bark bark bark bark bark.
Why is size of Rosenbaum even being discussed. Size doesn't determine ability to be dangerous.
Henry Cejudo 32 5'4" (163 cm)
TJ Dillashaw 33 5'6" (168 cm)
Frankie Edgar 37 5'6" (168 cm)
Demetrious Johnson 32 5'3" (160 cm)
Man, your post made me think of Tank Abbott. Not saying you're wrong but they're really only dangerous in the UFC against people their size, step up a class they might win, 2 classes they get destroyed. Now they can certainly beat people that have no fighting experience but I'd bet that only goes up to a certain size man. Tank Abbott talks about being able to beat Conor McGregor as a freshman in high school

Any one of those guys listed woukd beat the **** out of any novice fighter almost irregardless of size.
The size and fist fight arguments from the ADA were so absurd.
They were honestly trying to argue that he should stand his ground and go hand to hand with a mob.
Definitely, this is what Kyle would look like had he tried to fist fight Rosenbaum. It would have quickly turned into 2,3,4 vs 1. Shop owner trying to protect his business with nothing but his fist.

Go watch UFC #1 when there were no rules, no weight classes and no time limit
Royce Gracie beat everyone some having over 100 pounds on him.
I take Tank Abbott with a grain of salt, he's been beat more than my granny's dusty rug.
“ How you fellas doin? We about to have us a little screw party in this red Prius over here if you wanna join us.”
I'd argue, even novice, they'd have their hands full with a 6+ 220 size guy. They'd fold me up and hand my butt back to me but I think Tank has a point.
Royce was a goat. Reading the post above just reminded me of that Tank video. That's what they'd probably do, get the big guy on the ground, then break an arm or leg lol.
edit: Thanks for the video, early UFC was my childhood. Shamrock was a smaller guy that could take down giants with his superior wrestling skills.

If that's the guy in Dallas didn't he have a katana blade or something? But he was just swinging wildly, wasn't really committed to actually making contact, and got flanked.
Poor and fatal decision all around.
But yeah, what they were suggesting Kyle to have done was such ***** F that tub of goo.
One the lessons I remember from our CQC instructors is if we are ever faced with a group, unarmed and backed into a corner, kill the first person we can get our hands on and stand over the body. That way everyone knows what the stakes are.
Had it not been for the rifle this kid would have been beaten to death on the streets.

there is a former tu linebacker that thought the same thing until he took a nap on 6th street. Its been many years ago but ill try and find the whole video

Is that the one that punched the girl then Roger Huerta knocked his ass out?

Large man smacked him full power in thr head with a brick after he was down.. no attempt to find him by police. Media praised the assault on this man.

I remember that eff around and find out moment in tu football. He wasn't a foot taller and almost a hundred pounds heavier. Could be wrong though, certainly not an expert
I know of how one big county in Texas works. There are divisions, if you will, that try different crimes. An example would be juvenile felonies. There is a senior ADA who oversees all those cases. He hires new ADAs for his division, with final approval by the DA.
And these divisions kind of act as a "minor league" system. New ADAs start on juvenile misdemeanors, then juvenile felonies, then adult misdemeanors, on up. You can stall out at a certain level or just choose to stay. Not everyone wants the big murder cases.
While they're doing all these health mandates. When you have a morbidly obese SOB like this, why aren't they mandating a lap band or stomach staple to keep this fatass from stuffing pastries down his throat like it's his last meal.

Live stream outside the courthouse, tensions rising...
Where's Kyle Rittenhouse when you need him?
The story isn't that [DeSantis] "couldn't win" the primary. The story is that an overwhelming majority of our population is heinously stupid. 50% of them vote for communists. 75% of the remaining 50% vote for Trump, who cant win. When the majority of the opposition party insists on voting for an opposition candidate who can't win, you get exactly the government you deserve. - Well Endowed Ag
