Young one, do you have any concept of self defense?
Plenty. One may not simply shot another because they feel "threatened". Just as I may not stab someone who merely punched me in the mouth.

Both men in the vehicle are already at home. Self-defense. And they will walk, even in Austin.

So someone points a loaded rifle at you and you cannot defend yourself?
There's a good amount of nuances when considering self-defense. I would be glad to talk about them via DM. Here would just be akin to pissing in the wind. But to answer your question, in that situation you may or may not be able to defend yourself give other circumstances in play.

Absent something crazy, the driver will not be convicted. Period. This is still Texas.

I'm a great shot man! We would have won 'Nam if we had an army of studs like me.

Do we have "actual" statements from the driver?

I'm sorry but those first five shots are a rifle, not pistol. Last three clearly a pistol. Hard time believing first five shots came from the driver unless he had a rifle.

Yes, actually, any person who is LTC can discharge his weapon in public once he feels his life or safety is threatened.

Not so cut and dry. There are still other options one must take before simply firing their gun to defend themselves.
