As usual, I have a sidebar.

I saw Shipwrecked Crew was representing some J6 defendants, which I'm thrilled to hear. Based on some of the reports we've been seeing, a lot of the J6 folks are being held with NO bail and No charges, which dictates kidnapping and being a prisoner.

Why wouldn't a lawyer, any lawyer, suit the crap out of the feds? Even a died in the wool Dem judge would have difficulty supporting no bail and no charges for a defendant being held over a year.

It makes me wonder how many "prisoners" we've held with no charges or bail in the last 240 years.

There is an article about the Judge blocking Hillary's tweets as hearsay here.

Do you see any material concerns? The judge did mention it is "likely duplicative of other evidence", but it I am concerned it is just a move to put distance between her and this mess.

Ultimately, I'm not sure the tweets are relevant to the case against Sussman as the billing records establish his representation of Clinton's campaign during the meeting in question.

But it is a little odd that hearsay is the reason to exclude it.

Thanks, and I thought I needed more coffee.

If I testify to someone that I overheard someone say something, hearsay, no problem. I am saying something that someone else said and you have no idea to determine if it is rumor or true.

...but this is Hillary tweeting the statement. I guess someone else could have used her account to post it, but hearsay?

But it is not being offered for the truth of the matter asserted within the content of the tweet itself. Becuase the content itself was false.

Gets confusing on that point.

hillary isn't ever going to be on trial, but if the witness can be cross-examined on an out of court statement, its generally not hearsay.

In a sane world, they cannot. But is it illegal to make a false statement to the FEC? As in a criminal matter instead of just an administrative fine?

Remember for years FARA was just dealt with administratively with fines, not criminal charges.

But can their legal filings like this be used as evidence that what they are claiming in their briefs is perjury? This isn't a tweet. If it is something they filed with the FEC, doesn't that carry some weight moreso than other types of hearsay?

Was Sussman still counsel when those statements were made? If not, they are irrelevant as to him.
