That Brandon Van Grack needs to have his ticket ripped to practice law. Judge Sullivan, in the past, has been a real stickler on Brady material from everything I've seen. Unfathomable to me why he hasn't gone ballistic on the prosecutors yet.

ETA: IIRC, Sullivan's Brady orders include criminal contempt, meaning he can throw the prosecutors in jail.

Sidney's on fire! She's unloading on Van Grack and Team Mueller.

Quote:

The prosecutors hereat the time including Mr. Van Grack, Ms. Zainab Ahmad, and members of the Special Counsel team under the direction and supervision of Mr. Andrew Weissmannengaged in conduct even more pernicious than failing to comply with their legal and ethical obligations under
Brady and the D.C. Rules of Professional Conduct. They affirmatively suppressed evidence (hiding
Brady material) that destroyed the credibility of their primary witness, impugned their entire case against Mr. Flynn, while at the same time putting excruciating pressure on him to enter his guilty plea and manipulating or controlling the press to their advantage to extort that plea.

They continued to hide that exculpatory information for monthsin direct contravention of this Court's Orderand they continue to suppress exculpatory information to this day

I have been a huge critic of Team Mueller court filings because they were almost all narrative and less on the "crime" being alleged. Bad pleading form.

Sidney, however has used the narrative to connect dots, nearly all of which were ethically questionable if not outright illegal.

That, my friends, is how you draft a grenade pleading, then pull the pin.

She's good, very good. Just enough kindling to start the fire and then sit back and await the response.

(True story time although I wasn't involved in the case at all, just a war story I was privy to later. Involved a huge law firm accused of a conflict of interest case that was actually quite complicated in connecting the dots. But the lawyers drafting the complaint were very skillful and knew that their real target, the big law firm, would feel compelled to enter an appearance and file an answer even though they were not named in the suit. And they did! Petition was immediately amended and then they were a direct party. LOL. Twenty million later, the large firm, settled on the eve of trial. Point being, they goaded the large law firm into implicating themselves by responding to a pleading.)

Interesting analysis of the Comey memos. Indeed, Comey planned his actions to culminate in the appointment of a SC, but Comey it would seem had someone else in mind for the job...someone he knew well, all too well...someone who likely would have recommended both the impeachment of Trump & the prosecution of Hillary Clinton...Patrick Fitzgerald.

I remember that during a hearing a while back Judge Sullivan told Flynn that he had "sold out his country". Can he now be counted on to deal fairly with this matter? I really hope that someone with insight on this will weigh in.

Long story short, Team Mueller repeatedly lied to Judge Sullivan and he trusted them and went off based on their ex parte communications. A hallmark of a Weissmann prosecution, hide the ball from the defense team by claiming classified info and meeting one on one with the judge and lying to the judge.

He's no longer in the DOJ, Weissmann, that it. He supposedly teaching a law school course at NYU while he works on his book. But now it appears that unlike every other high profile DOJ US Attorney, no large law firm will hire him for a mid seven figure job. Malpractice insurance would go outta the roof for the hire of such an often sanctioned and reprimanded attorney.

Gregg Jarrett: Are you considering withdrawing the guilty plea?
Sidney Powell: That is not what I want to see happen here. I am expecting frankly that we find evidence that warrants dismissal of the case for egregious government misconduct. But like I said we want to know the truth. That's what I want to know first and I can't even evaluate the validity of the plea until I have all the evidence.
Gregg Jarrett: In other words, you want to lay out all the evidence and then a judge on his own saying, "Prosecutors on the Special Counsel team you are unconscionable, you are unprincipled, you violated the Brady rules, and because of your egregious misconduct I'm dismissing the case against Flynn. Would that be the optimal result?
Sidney Powell: That would be the optimal result. The man, I believe, from everything I've seen now should be completely exonerated.

Sidney Powell was interviewed on Lou Dobbs' program (by Gregg Jarrett filling in for Dobbs) this evening. I turned on the TV just as she was concluding. I can't find the video, but the above is a partial transcript.

Edit: Here's the video embedded in this tweet:

Thank you for posting that,

I do like Sidney as she is very good at her job and I agree with her approach on the Flynn case.

This was blatant misconduct. Dismissal is warranted even if Flynn was guilty as sin, which he wasn't.

For the non-lawyers following this thread, Andy McCarthy does an excellent job of breaking down how Comey's meeting with Trump on January 6, 2017 was investigatory ambush and one that was planned in great detail.

It was a set-up from the get-go. Not that many people on this thread didn't already know that.
Read the whole thing.

Although not nearly as detailed as McCarthy presented it, Nunes put out the exact same message yesterday (start at 3:00):

The IG report on the Comey memos is a building block to be used in the potential prosecution of a conspiracy against the President -- it proves that Comey was part of the alleged conspiracy -- & Nunes & Co. made 2 criminal referrals to the DOJ for conspiracy.

If conspiracy is truly on the table, or more precisely on Durham's radar, there's no way Obama and Biden are not singed, if not torched.

The January 5, 2017 meeting in the White House, the one memorialized by the infamous Susan Rice email to herself as Trump was inaugurated, is direct evidence of the planning of the next day's ambush of Trump by Comey. That meeting ropes in Rice and Yates as well.

If not 'endless'...it is enduring. Plus on the positive side, it seems that every attack the Dems have initiated has backfired and ultimately damaged their own image. MAGA!

Exactly where my head's been for a very long time ... 'Conspiracy to Defraud the Gov'

923. 18 U.S.C. 371 CONSPIRACY TO DEFRAUD THE UNITED STATES
Quote:

Quote:
In summary, those activities which courts have held defraud the United States under 18 U.S.C. 371 affect the government in at least one of three ways:

  • They cheat the government out of money or property;
  • They interfere or obstruct legitimate Government activity; or
  • They make wrongful use of a governmental instrumentality.

  • Quote:

    Quote:
    926. GOVERNMENT INSTRUMENTALITY

The fraud of wrongful use of a government instrumentality is characterized by the lack of threatened or real pecuniary or proprietary loss, or obstruction of governmental activity. An example of such a scheme might be the use of false United States Internal Revenue Service receipts to defraud private persons of money. Furthermore, the United States has the right to ensure that funds be administered in accordance with law and honesty without corrupt influence or bribery.

Thus, a scheme to defraud the United States can range from directly cheating or swindling money or property from the government to simply using the government in a wrongful fashion with the only injury being to the pride and integrity of the government. The case law demonstrates, moreover, that any injury to the integrity of the government is sufficient.

We all know this was a conspiracy. However ...

The circle was likely small and tight without much of a paper trail .... and the conspirators are fanatical zealots unlikely to flip. It will be no small task for Durham to build this case with the evidentiary hurdle being "proof beyond a reasonable doubt."

Well, depending on whether our appointed agency leaders give a tinkers dam about transparency (Wray and whomever the DNI is), then he might be able to do it. Of course, that assumes Durham pursues that route.

From my POV, he should go all Weissman, and imprison the families of Brennan, Comey, et al, until somone talks.!!
Hate is how progressives sustain themselves. Without hate, introspection begins to slip into the progressive's consciousness, threatening the progressive with the truth: that their ideas and opinions are illogical, hypocritical, dangerous, and asinine.
    This is backed by data.

Agree with your sentiment, but going all Weissman would ultimately just get the case thrown out. Need to select the one culprit who is sooooo self-minded that he wont allow himself to go alone to the gallows. In other words...a self absorbed coward. IMHO...Comey more than seems to fit that calling. It would only take one such 'brown trout' to crack the dam.

First of all, don't go all reason and logic on me!! Secondly, thanks for reminding me to use my brain, instead of how I feel.

For the next week or two, most of y'all would probably not want to be around me as I spout of various U.S.C. statues like I'm getting ready to take the Bar in a couple of weeks. If any attorney heard me talking about this topic, I'd likely get put in my place pretty quickly. Then I'd tell them I'm a Democrat, and they might agree.

"Paper" has a different meaning now. Comey's electronic trail has already been nailed down. And if the ******* used hammers and bleach bit, he's toast on obstruction and conspiracy. (If we had an honest DOJ, that is.)
