I've never really thought about that, but it seems to me that J Edgar was never going to be granted membership in the musketeers, being one for one, and all for one. I do believe he supported America.

I think Comey has some of that, but he seems more interested in Party, and not country. I'm not saying Comey isn't interested in self-preservation, his actions suggest America wasn't as important as the Dems were.

BTW, isn't Comey's daughter an attorney involved in the Epstein case?

I think you're replying to me, but I was under the assumption she was placed on the Epstein case in general.

I'm not even sure that's the case, so i wouldn't know which one. I know she's been placed on one of the high profile cases.

He said he decided to go public after the advice of and consulting with his mentor, Warren Buffett, who is a huge Hillary Clinton supporter. That would suggest that this will be a positive for Clinton. I'm guessing he doesn't care if it helps the Republicans, but is more concerned in trying to clear Hillary, while sticking it to the FBI and CIA leadership.

I actually got my opinion more from the Sara Carter article referenced previously.

It's just hard for me to believe that Buffet would advise him to do something to harm Hillary, or her cause. Also, Byrne's cryptic conversation / statements are ambiguous, especially considering his relationship with Butina.

Agree. Her original complaint, though an entertaining read, was long on narrative and short on the law.

Although it seems counter-intuitive for Halper to simultaneously assert he may or may not be a contractor with agencies of the federal government, for purposes of a Rule 12(b)(1) and 12(b)(6) motion to dismiss, that is allowable in that setting.

Apparently Halper took great offense at being called, "a rat-f***er" but calling her a Russian honeypot who had an affair with Michael Flynn was A-okay. As to the latter, unfortunately, Halper is correct.

I think they are wrong in their interpretation of the Halper motion to dismiss. It is citing two different and alternative grounds. One under 12(b)(6)--failure to state a claim upon which relief can be granted and 12(b)(1) lack of ubject matter jurisdiction.

Under 12(b)(6), the court is constrained to accept as true all of the allegations of the complaint. She alleged he's a government agent or contractor. So his attorneys are arguing that even if that were true, there would be immunity issues.

They are also arguing that the news articles in question are not defamatory, per se nor is there any evidence or allegation presented that Halper was the sole source, nor one of the sources for the articles.

They also have challenged her claimed damages as not compensable under the laws regarding torts.

Finally, there are Statute of Limitations issues as to several of the articles cited. And the only one that does fall within the SOL says Halper was contacted but declined to comment within the article itself.

So to recap: immunity, not defamatory per se, not a source, no compensable damages and Statute of Limitations are being asserted in the motion.
