So, let's say he couldn't see the glass window. Are you telling me his other senses are that dull? Could hear anything from outside the open window? Couldn't feel the breeze or temperature difference from outside the boat? Could smell the fishy dock air? Couldn't taste the salty air coming through the open window into his face? C'mon man!

Looking at that photo, the only reason he lifted her was to see out the open window. No way he didn't know the window was open. So much negligence on his part.

Assuming the pic is accurate, categorizing this as a 'play area' is a bit of a stretch.

Baby was probably slathered in sunscreen and the dude simply lost his grip.

it's possible he could have lifted her up to stand on the rail where there was glass to lean a bit and she shimmied down a bit to there the wasn't. But that would be (1) pretty agile for a one year old (and he should have been holding her regardless) and (2) he'd have to have his head surgically implanted up his ass not to realize it.

That window is at least three feet off the deck no toddler can get there unless lifted up by an adult or teen. Grandpa made a terrible mistake and that is it. RC is not at fault for Gramps not realising it was an open window.

Sue for a cool million.... cruise line says 1/2 to make it go away. lawyer takes 1/2 of $500,000 ..... 1/4 mil reward for grandpa dropping kid from 11 floors up.
Dang and some people get nothing for leaving their kid in the car for 5 hours......

In this scenario, this family gets to live the rest of their lives knowing they agreed that baby was worth $250,000. They're either delusional or terrible human beings.

Some of y'all must not have kids,or forgotten what it's like to have little ones. Their daughter was 18 months old, kids are CRAZY busy at that age and climb EVERYTHING. Whether that was a kids area or not, if it's accessible to anyone on the cruise then there should be some sort of barrier. Windows should only be able to be opened by staff. Hell a chair could of been slid over there by someone or even the toddler, she climbs up in 3 seconds and falls out.

Grandfather sets her on railing (dumb move) a couple of windows over, gets distracted by another grandkid, tit-tays, etc kid walks down "railing" and falls out, takes a few seconds. Cruise ships shouldn't be set up for that to be able to happen.

People don't always sue for money, but if you don't think that EVERY cruise line is reviewing how to make it impossible or less likely for this to happen again now that a lawsuit has been filed makes any of you thinking this is just about money as delusional as you claim these parents ae.

I've had kids and work with toddlers every day. This was not a high probability accident like drownings and simple falls. The parent was negligent. These open windows are not easy to access for someone under 2 feet tall. For this to be the first time this has EVER happened ever on a cruise ship means something!

(note I wasn't there and have not seen video footage that I'm sure exists- I have been on several cruises and know exactly what those windows look like)

"The grandfather of a toddler who died after falling 11 stories from a cruise ship window in Puerto Rico has been charged in her death. Chloe Wiegand, 18 months old, fell in July when her grandfather Salvatore "Sam" Anello lifted her up to an open window.

Anello was handcuffed Monday and escorted by Puerto Rican police after being charged with negligent homicide. He was released on $80,000 bond.

Police hold him responsible for his granddaughter's death, but the family blames the cruise line for the tragedy, CBS News correspondent Jericka Duncan reports.

"They find it unnecessary and unfair, and it's really pouring salt on the open wounds of this grieving family," said Michael Winkleman, an attorney for the family.

The Weigands say the 18-month-old loved banging on the glass at her brother's hockey games. That's why her grandfather sat her on a wooden rail in front of what he apparently thought was a wall of enclosed glass windows. But one window in the children's play area was open, and Chloe fell out of Anello's arms from the 11th story of the Freedom of the Seas cruise ship, operated by Royal Caribbean International.

"Had Royal Caribbean simply followed the rules and regulations that are designed precisely to prevent children from falling out of windows, we wouldn't be here talking about any of this," Winkleman said. ..."

Even if the cover story made sense (there is no question on those decks what is glass and what is not glass, they are tinted and not even clear in the best of circumstances) who thinks its ok to let their kid bang on glass like a hockey game on a window 10 stories high?

Now there is apparently video evidence that the grandfather leaned out of the window that he "didn't know was open" for a few seconds to look down. The situation is just so sad.

If that video is taking place at the same day and time when the toddler fell, then I'd say that's pretty damn clear at the very least the cruise ship is not liable.

Not only at the same day/time, but at the very instant that she "disappears".

Dude clearly picked her up & held her out the window a la Michael Jackson on the French balcony. Dangled her out there for 34 seconds?? She probably finally squirmed or shifted as he was pulling her back in and slipped.

He's guilty, cruise line is absolved, case closed.

The statement by the cruise line is pretty harsh, though - "grandfather is the reason that chloe is no longer with her parents". Yikes.

He made a terrible decision which directly led to the death of his grandchild. Instead of accepting responsibility, he lied about the circumstances, blamed his grandkid's death on the cruise line, and then attempted extortion.
